  • Hmm. I recall the charge being £260.00 in total, and have just re-read my case and found it is indeed £185.00 so yes they've clearly just tried to knock the £60.00 off (which I did raise as part of my defence).

Yep, think a counter-offer will be on it's way for something a lot less and I guess I'll see them in court!

    Thanks CM.

Out of curiosity, what signifigance does this hold in making sure this wording is on the 'counter offer'?

I Googled it and found this: -
The phrase “without prejudice save as to costs” is a term used in law to identify that discussions and offers made to resolve disputes cannot generally be disclosed to courts or tribunals, except where the issue of legal costs is being determined.

Latest VCS discontinuation (followed a path similar to the one your case is now moving along). Read this thread:

    Hello.

It's been a while since posting however I was just touching up a very long witness statement for my hearing when I stumbled across a blog post on the Parking Cowboys website from last July where somebody's whole case was thrown out because VCS had only provided a contract with a 'lawful occupier' as opposed to the actual landowner.

Now I just noticed in the claimant's witness statement sent to me for my case, that the contract they have provided in the bundle also shows that their 'client' is the 'lawful occupier'.

I'm just wondering if I'm on to something here or should I not get too excited about this?

Also should I raise it in my witness statement, or as it is more of a legal argument, just raise it on the day at the hearing??
