MET out of space PCN

Hi Guys
Someone recently received a MET PCN upon leaving my gym.
The reasoning was as The driver wasn’t parked in a space.
The gym had only recently employed the management of MET. The location the car was parked in has been regularly been used by members and at times where the car park has said to be at full capacity. Contacting the gym asking it to be waived as the car park had been full and saw nothing of it parking in the location. They came back saying they wouldn’t waive it as there are signs up saying if you are out of a space you will be fined.
Ideally the charge would be waived before taking this to POPLA.
Read through the other posts they primarily seem to be issues surrounding duration and was looking to see if there are any suggestions for an issue that is based on the claim of not being in a space.
There are the arguments of spending £X annually with them? Being loyal? Their terms stating the use of clamping not for a third party to issue a ticket?
Any advice would be greatly appreciated

First, edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper, who are two different people.

Parking scammers read these fora.
Have you complained to the gym manager/CEO? It's no point complaining to anyone else. If they won't help, cancel your membership telling them the extra £100 charge for genuine customers makes it too expensive.
Send the appeal template in blue text from post 1 of the NEWBIES, unaltered from the keeper. This covers your situation precisely. Do not miss the appeal deadline.
If/when it is rejected construct a popla appeal and post it here for checking. Get pics of the site and signage asap in readiness. Read the BPA CoP concerning bedding in periods where scammers have taken over car park mis-management.

Thanks for coming back to me, have edited so hope this retains anonymity.
I spoke with a member of the management team and held off on responding as wanted to read up on similar issues prior.
I will go back this evening and hopefully, this will get the dispute resolved.
With the appeal mentioned in post 1 should i do this as the keeper of the vehicle now or hold off to see if the gym can do anything ?0 -
They can certainly waive it for a member, never mind what the stupid signs say. Do the complaint FIRST, there are 28 days to appeal and that's ages to get it cancelled.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Nine times out of ten these tickets are scams so consider complaining to your MP.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.You never know how far you can go until you go too far.0
