BWLegal, random letter

Hello, so I have just been sent a letter, from a company called BWLEGAL. They state that around 3 months ago I received a PCN, from a company called TOTAL PARKING SOLUTIONS.

I never received anything in the post about this, and I have no idea what to do. I’ve been reading online about this company and they seem nasty.

It says “as You have failed to make a payment or raise an appeal within 28 days from the date of the PCN, the balance due remains outstanding......... which may result in you receiving a letter of claim pursuant to the pre action protocol for debt claims as containted.”

Then says about some sort of CCJ against me. Seems like a standard template for these letters.

The address on my letter is correct but the name is slightly misspelt.

They are asking for £70.00 for the PCN. And £54.00 as legal costs so £124.00.

Do I need to do anything or what?

    Yes, read the NEWBIES thread, and also, search this forum for BW Legal letter.

    Is there a chance your car is registered to an old address? Maybe TPS sent the PCN to the wrong address due to the DVLA having an old one that you've not changed for the car (never mind your driving licence, I am NOT talking about that).

    Your post makes me think you haven't yet read any threads about BW Legal at all, out of the THOUSANDS here. If I am right please do! You will need to get up to speed to defend a court claim unless it turns out TPS never sent any PCN to any address.

    The NEWBIES thread post #2 is where to start reading. Do a SAR (explained there).

    Do NOT ignore this. Treat it as a LBC and act accordingly. Read the NEWBIES thoroughly especially post 2. Common acronyms and abbreviations are explained in post 5.

    Check the details on your V5 are correct and up to date. The PCN may well have been sent to an old address.

    Send the SAR as already advised, and ask the DVLA who asked for your personal details and when.

    choose sa name that sounds simular and pester folk to death

    they say there is an active CCJ , then go to the likes of noddle and check NOW !!

    what no court costs ??


    if they are stating active CCJ this is fraudulent !!

    Are they saying there IS ALREADY a CCJ against you, or they would apply for one?

    This is what the whole letter says, sorry about the text formatting I can’t figure it out.

    “We have been instructed by Total Parking Solutions Limited in relation to the Balance Due for the above PCN.

    The Balance Due includes the £70.00 PCN charge plus Our Client's initial legal costs of £S4.00, which are detailed in the car park or signage terms and conditions. Our Client's terms and conditions are clearly displayed in our client signage.

    As you have failed to make a payment or raise an appeal within 28 days from the date of the PCN, the Balance Due remains outstanding and we require payment in full within 16 days from the date of this letter. If you fail to make payment or provide reasons for non payment within the specified timeframe, we will seek Our Client's instructions to commence Court proceedings against you, which may result in you receiving a Letter of Claim pursuant to the Pre-action Protocol for Debt Claims as contained within the Civil Procedure Rules (CPR).

    County Court Proceedings In the event County Court proceedings are issued, you may be liable for Court fees, further solicitors' costs and statutory interest. If Our Client successfully obtains a County Court Judgment ("CCJ") against you, then a CCJ may be recorded on your credit file for 6 years unless you satisfy the CCJ in full within a month of the CCJ being entered. A CCJ on your credit file may affect your ability to obtain future credit and may affect your employability.

We are keen to work with you and one of the quickest ways to review your account is to register on our Customer Portal by visiting (can’t post).     That's nothing more than a debt collector's letter.

    The clues are:

    1) "we will seek Our Client's instructions to commence Court proceedings against you" tells you that they do not yet have their client's permission to start a court case.

    2) "which may result in you receiving a Letter of Claim" - so this letter is not a Letter of Claim then.

    3) "we require payment in full within 16 days from the date of this letter" is confirmation that it is not a Letter of Claim. A Letter of Claim must give you thirty days notice.

    There is comprehensive guidance on how to deal with debt collectors letters in post #4 of the NEWBIES thread, but to summarise that post - ignore them.
