Shop non-delivery & refund attempt

Afternoon all.
I wonder if you could help me - I puchased items (comic-books) online on 2/8 (£16 ish), and assured that the comics would be "issued forthwith". With no delivery or e-mail recieved, however, I sent a progress chase e-mail on 17/8. Still no response, so finding myself near the shop today, I popped in to progress chase.

I was informed that the order had been part-cancelled and part-refunded (the main bulk of the order), and that the remainder I would have to wait for. I explained politely that I was not prepared to accept this (the p&p would be too high proportionate to the cost of the remaining order, and that I would like a refund of the remainder. This he done, whilst I was in the shop.

However, having got home and checked my bank statements, I can see no refund, either today or from the partial refund he said he made.

So in summary, I placed an order, with no items, and no refund. I'm in the process of writing an e-mail to him (I'm not prepared to phone - he was quite obnoxious). However, from my own experience of e-mailing him, and now having read other peoples reviews also, I'm not confident of a reply anytime soon. Where do I stand regards my rights, and what can I quote in my e-mail that is likely to spur a response from him. Can I quote consumer acts, or threaten small claims courts? What deadlines should I set for him to reply?

Awful experience - I wish I'd read the reviews first!

    Raise a charge back claim with Bank/credit card co. for non performance of contract.

    Bank transactions do not occur instantly - it can't have been more than a couple of hours since you went into the store!

    Thank you all for the assistance.
    I appreciate that today's partial refund may not appear today, or even the next day or so. However, the partial refund that he said he had issued previously has not been recieved either (this would have appeared by now).
    Do you think I should e-mail explaining that no refund has been recieved, and that a 'LBA' would be sent (recorded) should no response/refund be forthcoming in the next week or so?

    No, just send a polite email in the first instance enquiring about it. If you go all nuclear at the start he will just drag it out (he may do that anyway but not much you can do about that)

    Don't use Recorded (Signed For). Just obtain Proof of Posting from the PO. 1st class mail is deemed to have been delivered within 2 days I think. A Signed For letter could be refused.
