Over 3 years ago my daughter recieved a parking fine from excell stating she hadnt displayed a ticket ... i was with her and gave her the money myself !when she rang to tell them they then said she had displayed a ticket but not a valid one !!! She then asked for evidence and they sent her a foto of her car reg ... she rang again and said that wasnt evidence so they said they would look for further details! No contact from them until this month (Aug) saying if she didnt pay up they would be sending bailiffs... she was terrified as you can imagine ! Next in the post she got a ccj saying that the case had been to court in her absence!! She has spent years building up a very good credit score and now is scared she will lose it ! Excel have told her she has 3 days left to pay tho the court has said she has a month where she can have the hearing PUT ASIDE ! At a cost of £250 and then she may not win so the cost goes up even more !!! Please can anyone help as shes upset as we both know WE PAID ...

It's either pay the £255 for the set aside, or pay in full before the deadline to stop the CCJ trashing her credit rating

Nobody can help, those are facts

Set aside for £255 and defend the original court claim, or pay up in full asap

    Her choice to make

Well you can attempt to set aside by consent for £100 and/or they may qualify for fee exemption.

It depends on personal circumstance and the reason the court forms were not received as to what path would be best.

Did she receive the court claim? If not, any reasons why the claim might not have been delivered - move of address in the period since the original parking ticket?

    Or simply ignored?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
