car insurance excess

Hi, my car was involved in an accident late 2015, third party details passed to insurer. Car went in for repair and offered courtesy vehicle. Collected car after repair, no excess payment requested. Insurer has written a few times asking if I would be prepared to attend court. I would. Today received a letter stating 3rd party insurer disputing fault for accident. "As a result your claim will now be handled by our Damage Fulfilment teams until such time that the liability has been resolved."

Any suggestions as to where I stand with regard to potentially being asked at this late date for an excess payment?
