  • The BPA response I got was:



    As a Trade Association and not a regulatory body, we do not get tickets cancelled - nor can we overturn POPLA decisions and I see that they have decided in favour of ParkingEye. POPLA have their own internal complaints process and if you remain unhappy with their decision you need to refer the matter to their complaints team.

    The Code does not provide a way for a motorist to challenge how private land is enforced as outlined in Code clause 6.4. The landowner can decide what is a suitable grace period for entering their private property, we do not determine that; and in addition, the Code gives a guide of a minimum of 10 minutes at the end of the parking contract, but only if the full terms and conditions of the use of the site have been met.

    Regarding whether a contract was formed with the driver or not, is not for us to decide upon. If you wish to continue to dispute the matter, I would suggest obtaining legal advice as to what your next steps may be.

    I don't understand what the Assessor means. You can't have to pay a tariff for a free two hours. Reply and very briefly ask what she can possibly mean, and that you require John Gallagher to review this matter because the complaint response is plainly ludicrous.
    I contacted a shop which informed me that the signs and meter were put up on the 20th of June and my parking charge was on the 10th of July, I have been parking in this car park for years previous to receiving this charge.
    Did you:

    1. complain to whoever runs this retail park?

    2. include a point about the BPA CoP requirement for EXTRA signs for new rules?

    I will reply to the Assessor about the points raised, I complained to the people who owned the carpark but unfortunatly have recieved no reply.


    I also did not include a point about the BPA CoP requirement for EXTRA signs.

  • So It doesnt look like POPLA are going to respond to my E-mail, It looks like I am at the end of the road, does anyone have any reccomendations on what I could do next? Am I likely to win this in court or should I just pay up for the sake of the hastle.

    No idea , court is a lottery , the choice is yours , but judges don't always agree with popla , we have seen many people win in court who lost at popla

    Yes, you have a case and this can be distinguished from the Beavis case. You have the ten minute grace period and nothing has changed!
    The ANPR cameras show your entry time as 17:57 and the exit time as 20:07, totalling a stay of two hours and 10 minutes.
