Cancelled Goods Delivered

Hi there,
We ordered a set of 4 dining room chairs from shop A. The tracker then reported these as lost. Shop A apologised and re-ordered the chairs, with the same result. Again another apology and a re-order with the same result. We then cancelled the order and received a £20 gift card by way of apology.
We then went and ordered similar chairs from Shop B. This is where the fun begins. On the day the chairs from Shop B arrived, 10 of the 12 chairs from Shop A also arrived! We have therefore gone from having 0 chairs to 14 in the space of a few hours.
Question is what can I do now? Can I flog the chairs I don't need? Do I wait a while and see if Shop A notices before doing anything? Or do I legally need to return them?

Well, Adam must still be considering the situation, so I'll answer.
Can you flog the chairs you don't need? No, unless their owner gives their consent for you to do so.
Do you wait a while to see if shop A notices? Up to you, as long as you can store them securely for as long as it takes them to notice.
Do you legally need to return them? Given that you don't own them, yes (unless they tell you you are free to do with them as you wish).
Oh, and please don't counter with the overused "unsolicited goods" argument. They're not unsolicited.0 -

Obviously you refuse delivery because it is a mistake...
But by the sounds of it, you didn't do this, so you need to contact the shop (preferably in writing) and ask them to collect the chairs at your convenience.
You could risk not telling them, but they have 6 years to chase you for the money that you would then owe...

You're an "involuntary bailee".
Contact Shop A. If they want them back, make the chairs available for Shop A to collect at their own expense.
You can only sell them if Shop A make no attempt to collect them, even after you have contacted them twice. Even then, the money belongs to Shop A.If it sticks, force it.
If it breaks, well it wasn't working right anyway.0 -
Probably thought they were onto a freebie, otherwise why the hell would you accept delivery.
I wonder if the missing 2 chairs will ever turn up0
