DRP Letter before referal for legal action

Hi All,

quick background.

We have a dispute with Parking Eye.
Our defence lies with the fact that we did not enter into a contract because of inadequate signage.
We followed the advice regarding PE appeals and POPLA appeal - both were denied as predicted.
We live on a narrowboat and so move locations occasionally. We received some letters from PE/DRP much later than was ideal and so filed them with the rest of the correspondence.
We have changed our address with PE and kept them up to date.

We have recently received a 'LETTER BEFORE REFERRAL FOR LEGAL ACTION'.
This is the third such letter we have received, albeit they had different titles, such as 'Notice for intended court action' and Letter before County Court Claim'. (This last one we received some weeks after the deadline to respond had passed because of our change of address issues.)

My question is - does their lack of action indicate their reluctance to go to court?
Can we expect them to suddenly spring into action and take us to court?
Does this sound like their usual scare tactics?
What can we expect next?

    DRP, Zenith (DRP in a dress) ZZPS, so called solicitors letters asking you to contact one of the above can all be ignored, they cannot issue a claim only the Parking Company or their solicitors can.

    You have several questions not just one. The answer though is simple and is who knows?

    I'm actually not being flippant. The ways of Parking Eye are mysterious of late. They might ignore you, harass you, take you to court or just give up. It's impossible to say at this time.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    I'd say three letters is unusual for P/Eye and maybe the fact you live on a narrowboat is putting them off.

    seems like we just sit and wait.
    I wonder if there are any cases where they simply stop sending letters, go away and the statute of limitation kicks in?

    On another note, how will we know if they are actually going to take us to court - and what should we do then?

    6 years is the statute , 5 in Scotland , been that way since 1973

    An MCOL court claim N1 pack comes from the CCBC in Northampton, in the post , probably issued and paid for by Parking Eye

    Then you read post #2 of the newbies faq sticky thread near the top of the forum, same as everyone else
