Halifax want their goodwill payment back

:mad: I have just replied to Halifax to comply with a deadline they have set but can they ask for money they put into our account following a bank charges claim. We didnt accept it but it was put into the account, this is £500 short of the claim we have made - in the middle of the claim, the test case started so as far as we are concerned it will just have to wait until then but now they are demanding their money back. We have told them it would cause us extreme hardship if they take it but has anyone else had this? thanx

  • When they offered this money, did you return a letter accepting it as only part payment. They usually say that if you do not reply they will close the complaint after 8 weeks

  • Sorry bit slow replying - no we didnt accept it and there wasnt a deadline. We basically put 2 claims in separately for each account we had. One was paid by one person, the 2nd was looked at by another and disputed. We went to court but the test case had just been announced within 1 day of us getting there and they sent a barrister. We have now had a letter in response to ours saying that we must be confused and trying to make out that we had one claim on 2 accounts not 2 claims on 2 accounts. They have said that they will look at it again on 2 January. We will write back and advise them that they have got it wrong but still not sure whether they can take the money without our say so. It would cause us genuine hardship and we have told them that so hope the test case gets sorted asap and they will wait until then for a decision on the case as a whole. we feel they have messed up and have now realised and want the money back :rolleyes:
