Yes, you need to make wills.

As others have said, you need to think about
    (i) who you would want your children to live with if you both died while thye were still minors, and
(ii) who you would want to look after tthe finacial assets for the childrne, if you were to both die while they were still minors (whichwill often be the same people as (i), but doesn't need to be, if you feel diferent arrangements are needed.

In elation to Care home fees, if you really want to try to avoid them then you absolutely need proper advice and a will, however,I would suggest that you recosider. If you end up needing care, why on earh would you want to prevent your family from finding you the best opossible care that they can? Not to mention the fact that the government is doing what they can to close loopholes so you could find that it backfired very badly on you.
If you have a situation wehre one of you needs care and the other is still living in the family hon, then the family home won't be sold as long as one of you is still living there, there is no question of being made homeless becuase your spouse needs care (the local authority would take a charge over the hosue and the fees are paid when the hous is sold fter the second spouse dies or moves into care)
All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)
  • Intention is:
    - If either husband or wife dies, then everything goes to the other surviving partner.
    - When both dies, then everything goes to the children divided equally

And if you all pass together???
