Hello all
This is my first ever post on this wonderful forum without which I’d be totally lost and floundering.
Can anyone help me please with a transcript/judgement of the UKPC v Mr Aziz case? I’ve found lots of references to it but no actual judgement.

Thanks in advance.

Very few cases have a verbatim transcript unless the defendant or claimant pays for one, and then they are not in the public domain unless the purchaser puts it there. They are expensive, hence their scarcity.

Here is a link to a Parking Prankster blog about the case, but please note that a defence based on 'No genuine pre-estimate of loss' (GPEOL) no longer has traction, so don't waste any time going down blind alleys on that.

Are you aware that the NEWBIES FAQ sticky, post #2, written by those legally qualified and those with a keen interest in court processes, takes you through all the stages of a court claim?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Thankyou both. Yes, the PP blog is known about - he mentions it but there's no transcript there. It wasn't wanted for GPEOL, it was wanted for the judgement that UKPC did not have authority to override the lease and issue charges. Never mind, other cases will be quoted.

Defence in the process of being drafted and will be posted here for your comments shortly.

Well done on having done your research before starting a thread. This helps the regulars a great deal.

Just in case you haven't already found them, here are a couple of things that might help.

This one is very recent. You might want to start at around post 93 onwards and then look at the events leading up to the judgement afterwards.

    Have you reads this?

Nearly all of these cases are won by the resident because their lease/AST takes primacy over the PPC's so called contracts. They can offer you nothing which you do not already possess by virtue of the contents of your lease/AST.

Nine times out of ten these tickets are scams so consider complaining to your MP.

Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

  • Hello all
I’ve almost finished writing my defence and aim to post it for your comments later. Just one query - you sometimes advise people to use Dropbox for posts for greater confidentiality but how do you access them? Aren’t they password protected? (You can tell I’ve never used Dropbox). Thanks.

Other web hosting sites such as Postimages or Tinypic are available. Don't use anything that requires a password otherwise the regulars won't be able to access it.

Alternatively copy the text into wordpad/notepad or similar and paste it here.
Don't do it direct from Microsoft Word as it boggers up the formatting.

Don't worry about confidentiality as long as all persona data is redacted. The scammers will get to see it soon enough if you have a court case pending.
