Popla appeal preventing withdrawal of pcn

I have asked the car park owner to request the withdrawal of the PCN which they have done. However , the operator has rejected their request because I have already entered a Popla appeal . (I guess they think they have a high chance of winning the popla appeal)

this is infuriating !
what can I do other than ask the owners to follow up again?

    Do that plus inform popla of this, plus complain to the BPA and your local MP

    The PPC can tell popla they are not contesting it, Apcoa do this all the time

    Complain to the BPA, even if the win imo they are Friar Tucked.
    You never know how far you can go until you go too far.

    Do you have an email or such like from the principle that they want the operator to cancel the ticket?

    Keep hold of that. Even if POPLA fails then it's a major barrier to them trying court.

    Can you post up the text of your POPLA appeal please? The full thing not edited highlights.

    Who is the PPC It's simple for the PPC, they just say to POPLA they withdraw

    You need to ask the car park owner who is the boss, the PPC or them ???

    This was the original post. To be fair the op hasn't had a reply yet so it's probably best to let this thread run


    I am new to this forum and hope you can help me as I suspect I am one of those people that the operators rely on to just pay up and I am fed up of their tactics. I am however feeling a little overwhelmed now having read all the newbie pages.
    I parked on private land at the invitation of the owner with a legitimate reason ( and proof) to be there but I failed to register the vehicle with the operator who issued a PCN. I appealed directly but they rejected it and gave me a POPLA no . As I was going on holiday I submitted a popla appeal to a PCN from CE in a hurry and didn't do my homework with you guys first so Ive not given myself the best defence. ( I am very cross with myself) The owner has written to CE on my behalf to withdraw the PCN which I included in my POPLA appeal along with a no material loss argument but so far no joy. I have now received a response to the popla appeal by the operator. I know I need to comment on it within the timescales and am looking for angles. Before I draft something up can you help me focus on what might work ? They major on there being adequate signage , the contract , Beavis to justify the charge. Is my best chance of success ( unless they cancel it) to focus on no evidence of authority to issue PCN by owner - ( in fact the reverse ) and how much new stuff can I add in at this stage? Thanks in advance . all help gratefully received.

    Tell the owners you will withdraw your POPLA appeal if the PPC confirm by email that they will cancel, today.

    #Time is of the essence as POPLA will make a decision that costs the PPC money, after 21 days. So you need to get your ducks in a row asap.

    You do not want the POPLA appeal to be adjudicated but can't withdraw it without the PPC's absolute assurance of cancellation of the PCN.

    Or as beamerguy says, ask the landowner to tell the PPC to withdraw.

  • Ill get on it but I did it before I found you guys so its very amateur . I hadn't realised how legalistic POPLA is!
    Owner is being helpful but has been told they are now a 3rd party due to POPLA so are forwarding emails as well as emailing PPC again using breach of BPS code of practise argument and option to not contest it.
