Personal Injury claim

In Nov 18 I chose to go for multi car insurance with LV to include my partner's car insurance with mine. I had 14 years plus no claims bonus and doing this considerably reduced the cost of car insurance for my partner. A week later we had a knock at the door from a policeman regarding the incident. My partner came out of a junction before a slow learner moped rider who was coming down a hill. The lady was so slow that my partner decided to pull out before her (we've all done it!). He pulled in to a car park numerous meters away and before he could turn off the engine this lady was banging on the back of the car shouting "you forced me to stop and hurt my knee " a pre-existing problem she had.It took her seconds to get to the car bearing in mind she had hurt herself having to stop so abruptly and the car is faster than a moped! I might stress there was NO COLLISION. The lady claimed she was forced to stop on an already damaged knee and called the police regarding the incident. The lady was also insured by LV. The police investigation claimed there was no prosecution regarding this incident. However. my insurers upheld the personal injury claim and our car insurance trebled in cost! I felt that we had been scammed by this person and protested this to the insurance company her report to the police changed from the initial report on the phone to a signed statement to the police. She went to one of these claim solicitors and eventually claimed for neck,and back injuries no claim for the knee injury that she had first protested about. I feel pretty cheated by this event and was convinced my insurance company would see this as a scam and all would be OK! wrong! as stated they upheld her claim.
I don't understand why the insurance company failed us apart from the fact that both parties were insured by the same company. We were the cheaper option?
Does anyone have any advice? always appreciated as I'm a firm believer that there are experts out there!:(

Insurers do have the right to deal with claims as they think fit
But you think you have been treated unfairly then the route to go down is a complaint in line with their complaints procedure
.
Then if you are not happy with the reply or they ignore you for 8 weeks you can escalate to the FOS for their adjudication at no cost to you0 -

What I forgot to mention is the police officer stated she was already known to them!
I was sure the insurance company would see this was an attempt to get money out of the insurance. Even though we are nearly a year on it still has that niggling affect of wrong doing but felt I had no where else to go with it but I will take your advice and complain. Once again thank you.:)0 -
For some reason I cannot post a new thread but hope someone here can answer my query.
I was involved in a non fault collision where someone ran into the back of my car at low speed. I did not report or claim any injury at the time. I remember being able to feel where the seat belt crossed my collarbone but did not claim as i didn't consider it an 'injury'.
The claim was settled over a month ago and I got full insured price for my car and considered that to be the last of it.
I was called today by a company stating that the other party had claimed for minor injuries before it was established to be her fault. These were non visible injuries that they did not seek medical attention for. As she was found to be at fault I have been told that the money set aside for her claim could be mine as it would be expected I would have suffered similar discomfort. Apparently if I choose not to claim it the cheque expires after a year or so.
Is this a scam? The person on the phone was very pushy, trying to reassure me that its just verbal confirmation required that I suffered discomfort and then a courier would come to my house to sign the forms. Then they would contact a solicitor as apparently I need one to receive the cheque. I don't believe that is true. I was very careful not to confirm or to commit to anything but asked for all the information in writing first which they said they would not do unless I first completed the questionnaire over the phone.
I cannot find any info on this on Google as I am just bombarded with personal injury lawyer companies regardless of what I type in. I forget the name of the company but googled the phone number and common consensus is that it is a scam.
Can anyone answer what the process is if the other party claim but then its judged to be their fault?
They are to call back tomorrow but my gut feeling is to tell them where to go0 -
Follow your gut feeling, tell them to politely go away.
Over the next few years, you will get ountless calls doing exactly the same.
Just tell them you have not had an accident and they will soon go awaymake the most of it, we are only here for the weekend.
and we will never, ever return.0
