    The OP mentions an "old lady friend" - if one takes this to mean a post state pension age female friend of the family, I should think that her state pension (which may be boosted by her entitlement to additional pension from late spouse's SP), any occupational pension of her own plus the widow's pension from her husband's provider, are enough to make her ineligible for any means tested benefits.

    Yet the point remains, the money from those sources can be used to pay for rent, dental treatment etc.

    I didn't say it couldn't.

    I was merely saying that it seemed unlikely that ESA was the benefit involved.

    Given inherited pensions are disregarded for ESA(C) it must be a decent size of pension if it is knocking her out of income related entitlement altogether.

    Nothing has been fixed since 2008, it was just pushed into the future

    You haven't said how much the pension is and pensions are counted as income when claiming means tested benefits.
  • Hi guys,
    Just a little update re my first post. As I stated the lump sum payment was subject to income tax taken by HMRC, I submitted form P53 (reclaim tax on lump sum pension payment) and I received a tax rebate for nearly the full amount taken in tax.
    I hope this information is of some help to someone else out there.
