Bank Charges claim going to Court - Can anyone help?

Hi, this is my first time posting a thread, hopefully someone out there can help me?

I had my bank charges case put on hold awaiting the test case but I applied for the stay to be lifted and was sucessful. I have a court date for 7th Janaury 2008 but I have no idea where to go from here?! Can anyone help?

I rang the court today and ask if there was anything else I needed to do but they said I shouldn't need to submit anything further. Do I need a solicitor? According to Martin I should be able to do it myself but I have no idea how to go about doing that? Has anyone else been in this position that can help me with what I need to do and what I can expect?

    Im in the same situation as you, going to court on the 5th dec, and i havent got a clue...yet!! But i really really want to win, so will do all i can to get prepared, so Good luck to you as well, and if you get any tips, please post them here as i could get some advise too

  • Hi, I seem to be in the same boat as you guys. I successfully contested a stay and have now had a hearing date set for January 29th.
    Before we left the court last time the judge pulled me aside and hinted that i may be out of my depth as we will be debating not just the facts but also points of law, which is a bit worrying. If either of you get any pointers from your cases i'd love to hear them.

  • How the heck do you get a 'stay' on the court date lifted?
    I was going to court months ago, then 2 days before the date, I had the 'stay' letter. I then heard you had to be at the debtors door to have that 'stay' lifted. So I gave up. Thats where I am now, I have given up on £2500 of bank charges...thought that was the end of the road!!!!
    What do you do to get it lifted and does it cost yet more money?
  • It costs £35 to have the stay lifted, if you look online there are places that help you with what to write, such as everyone has the right to be heard in a certain amount of time etc.

    I am worrying slightly about what nmcnelis has said now though, as I will be out of my depth if I have to start discussing points of law!!
