Letter of claim from bw legal...so confused

My son has received a letter of claim dated 1 aug 2019 from bw legal. Claim was he failed to clearly display a valid permit (it had blown into the footwell when he closed the car door) on 4th march 2016 when he was at our local college. He has until 5th sept 2019 to pay £100 balance and debt recovery cost of £60, or respond with the reply form enclosed with the letter. He had previously responded to the parking company, appealing the pcn, with no success. I am panicking so much about this as he really doesn't need a court case and fine hanging over him like this. I have read so many posts and threads on here and to be honest, the more I read, the more confused I get. Bw legal are now estimating principal debt and initial legal costs £160, est interest £27.29, est court fees £25, est solicitors cost £50 =£262.29! He can't afford it! Can someone please advise where he can go from here? Am happy to provide more info if needed.Thanks

    You simply need to read the 2nd post of the NEWBIES thread about LBC stage. Easy enough to email a SAR to the PPC and for him to buy some time by emailing BW Legal to say he is awaiting a SAR and is 'seeking debt advice' and denies the debt in any case.

    The magic words in inverted commas above, buy 30 days respite to try to get it cancelled, which should have been the first thing to try ages back. Complain to the landowner if the local college is currently open, as a cancellation is possible from any landowner.

    Someone instructed them and that person/company can tell them to wind their necks in. If they are only open in Sept then the reply to BW Legal gets him to that date with no court claim in play.

    Having a court case to defend is not a bad thing, a good life experience and we have a 99% win rate here in well defended forum-coached defence cases.

    No CCJ risk, nowt bad even if lost - and less than £262 even if he is a 1% lost case person - and the scam will be over ad reduced in cost, no effect on credit rating. Remember that 99% report wins here and claim their costs, usually.

    Who is the parking company ?

    THE FAKE £60 ???? In your case they are saying debt collection costs.
    BWLegal live in a wonderous world of scam. They make it up as they go along, debt collection is amongst one of many they dream up.

    In reality, the courts don't allow this and recently, judges have kicked BWLegal out calling it ABUSE OF PROCESS and it is against the courts own ruling of DOUBLE RECOVERY

    INTEREST ... doubt a court would allow this as they have taken a long time and it can be seen as profiteering

    ESTIMATED COSTS. These are fixed fees and they know it

    It's the ABUSE OF PROCESS from BWLegal

    You do need to reply to a letter before claim, so ask them for proof of debt collectors charges and enclose a copy of the permit advising that you wil provide this in court.

    Judges know all about BWLegal, they have whooped them many times
  • Parking company is Norwich Traffic Control Limited. Doubt my son still has the parking permit, however, college would have had his details on record to provide him with a permit, so will have to look into that. And at the same time will explain how this company treats the students that use their car parks! Thank you for your response.

    Well you need proof and Norwich Traffic Control Limited really are a bit of a joke

    Just goes to show that BWL will take on anyone's dirty washing just to get a scam £60 ???

    Perhaps something like:
    Dear Sirs,

    I am writing to you in reference to a Letter of Claim that I received from yourselves regarding a PCN from Norwich Traffic Control.

    I have requested a SAR from them, and am awaiting their reply.

    I am also currently seeking debt advice, and in line with para. 4.2 of the Pre-Action Protocol for Debt Claims, request that you postpone further action for thirty days.
