Being Priced Out Of Insurance Due To Open Non Fault Claim

Involved in a bike smash in UK, significant injuries to me only. Clearly the other driver’s fault, witnesses, no mitigating circumstances etc. Police found the driver highly likely to be guilty of driving without due care etc and told me in writing, as a friend in the legal profession said, gold standard in terms of liability. They are offering for her to do driving retraining at her expense or be prosecuted. She’s refusing to give a statement to her insurance company, so they have already paid for the bike on a without prejudice basis. But their official stance is neither deny or accept liability for fear of opening to a possibly quite large personal injury claim, I guess while there is any hope at all, of getting out of it. They have until Oct to gather evidence before my solicitors can force legal action.

On my insurance record I’ve got a nearly expired theft (I wish I'd never made as was small claim and paid every penny back in premium), wind screen claim on my car from a few years ago, a report of an incident because some idiot drove into my foot peg and scratched his car, nothing came of it, I reported it to be safe last Year.

And the straw that has broken the camel’s back, which is when you have an outstanding claim like this, the insurance company are apparently entitled to assume it’s going to be a huge claim and against yourself. VS with this claim resolved, I’m looking at £700-£1000 added onto my premium to get my car insured when it expires in September, which is a monumental increase and with other commitments, I can’t afford it without getting a loan or a credit card.

Some insurers won’t even talk to me as they see 4 notes and somehow the windscreen and a reported incident are treated on par as the others. My car insurer wouldn’t even explain it. The comparison sites don’t really seem to work, as I choose the appropriate options. I get on the phone and I explain the situation and it’s doubled.

My insurance expires in September and I need a decent car for my job as I do a lot of miles. Anyone have any recommendations for an insurer that can look at me as an individual and realise Bikes are 87x more likely to be in an accident, I’m not insuring a bike (which are dirt cheap weirdly!). The only claim I’ve ever made on a car was a windscreen, I’ve got a fully clean license, homeowner and 5 years NCD. I should know better than to be surprised, but I just cannot believe considering the criminal threshold is so much higher, that the insurers are acting like this is somehow going to go against me. Already dealing with an already crap situation and this is just another worry I don’t need.

    get a broker to look for insurers for you, (not Swinton)

    If you were injured why not make the injury claim,?

    Especially if you have been told that they expect you to make one!

    My Solicitors are proceeding with a personal injury claim, but due to the 3rd party's lack of co-operation, the 3rd party insurers valid right to investigate and the already very lengthy process that is personal injury claims, I would be surprised if I see any money this year, so unfortunately does not assist me with my present situation. I've been unable to get assistance of any kind until this is resolved.

    What I meant more is, they won't admit liability a single day earlier than they have to while I'm still injured, hypothetically say I am still healing from X bone broken now, they admit liability, that bone, ligament etc could still be causing me problem in a years time. They open themselves to possibly unlimited liability. And as their client is refusing to give a statement, I guess they are very reluctant to do that.

    Have you asked your solicitor handling the personal injury claim if you can include the include the increased insurance premium in the damages? Then just swallow it and move on.
  • sal_III is right, the only redress here is to notify the 3rd party that you will have to take a loan to cover your insurance costs now and will be passing the cost on to them. Their client is the one causing the extra cost to be incurred, so will have to pay it.
