Parking Eye County Court Claim form received today - assistance required please
tillyl
Good afternoon,
In May of this year I visited a hospital for physio. The vehicle I used is registered to my husband.
A few weeks later my husband received a Parking charge notice from Parking eye. It appears that I should have put the vehicle reg in an ipad machine in hospital reception area.
We ignored the letters - stupidly listened to friend advice.
Today my husband has received a Northampton CC claim form.
I have read through the posts on here and my head is becoming a muffled mess!!
I can obtain proof that I was a patron of the hospital with an appt confirmation.
My husband can prove he wasnt driving or near the car on said day as he was 20 miles away at work.
The reason for my confusion is 1. I keep reading about not disclosing the driver 2. Will they actually care that I was a hospital patient?
I understand that I shouldn't start a new thread as the info is on here somewhere. However if you could point me in the direction of a thread with the correct defence terminology relevant to this case I would be very grateful.
Thank you

Whose name was the NTK in ? Husband ?
Whose name is the claim form in ? Husband ?
If it's all in his name it's nothing to do with you, sorry to say
He must deal with it all driver or not
What is the issue date from the top right of the claim form ?
If PE followed POFA, then as keeper he can be held liable, which is what seems to be happening
What did PALS say when you complained after the first PCN arrived ?
Did the first NTK arrive within 14 days ?0 -
As advised this needs addressing by the named defendant
All advice on Court claims is in the newbies FAQ thread near the top of the forum
See post#2 there
First job for the defendant is complete the AOS
All covered in that thread
Once done it buys you an extra 14 days to get the defence in0 -
What does he need to know that's not already covered by the example defence about the ParkingEye case and the hidden keypad?I should have put the vehicle reg in an ipad machine in hospital reception area.
Today my husband has received a Northampton CC claim form.
It's one of the defences you saw linked when you read post #2 of the NEWBIES thread. Not sure why it was seemingly overlooked when clearly (to me) it's perfect for your husband's defence, with a little tweaking to remove stuff about the Odeon cinema.
What's the date of issue of the claim (top right)?
You cannot acknowledge and defend. HE MUST.
It should be mentioned in passing in his defence, yes, so he should add it to the example about the hidden keypad, when he edits the stuff about the Odeon out, he puts stuff about not being the driver and that the driver was a NHS patient, etc. Will they actually care that I was a hospital patient?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Nine times out of ten these tickets are scams so consider complaining to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
Also, many judges regard this as a trifling matter, a waste of court time, and not really a breach of contract at all.

Thank you for responses.
Obviously I won't be fighting the claim in my name!!! I will be administrating it but it will all be done by husband :rotfl:
I'm intrigued how you know what threads I was reading before I had even registered and posted - bit shocking!!!
I will indeed use the cinema case for reference.
(or rather husband will
)
Thankyou0 -
The other questions near answering too
Ntk arrival period from incident date ?
Issue date on claim form ?
What PALS said when you complained at the time
Etc0 -
If this ends up in a hearing then the defendant must attend!0
