Who do you intend to take to court? Assuming it is your insurance company they will likely have good legal representation.

You have been quite harsh. Saying that people were not there. As there is no dash cam evidence anyone judging the case would need to go on what you say happen.
From what you have said you may have been able to avoid the accident. Yes, 3rd party was a tool to drive into the side of you. Sometimes it is best to give people like that a wide berth. You can normally spot them. It really isn’t worth the hassle of dealing with a claim like this.0
