EQUITA PCN Take formal notice advice!

I have received a letter from Equita stating that I owe £408 for an outstanding PCN from a city council where I live. I never received this PCN in the post. This is the first I have heard of it. I contacted the council who stated that I should apply for a PE3 out of time application. This is all well and good however I still do not know the actual PCN number. I dont want to contact Equita as they have a terrible reputation online as a debt collector and I am wondering if I should just ignore this. Which doesnt allow me to pay the original fine. Any advice would be very helpful!

    As we major on private parking tickets here, PePiPoo will be your best bet for council tickets. Register there (but please note that a hotmail address won't work - try using a throwaway gmail account instead if you do have trouble registering) and post a new thread; here's your link:

    Have a read through some of the other threads there before you post your own to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the council (both sides, if appropriate) as they need to see all the small print.

    PePiPoo has an excellent success record in dealing with council tickets.

    In addition:

    You will also need advice on bailiffs.

    For this you will be best served in dealing with bailiffs/enforcement agents by making contact with 'Bailiff Advice Online'. Sheila, who provides this excellent service, has an extremely good reputation for assisting people with bailiff issues.

    What the council are advising you to do is to submit what is called an Out of Time Statutory Declaration. In simple terms, this is a formal application to request that the debt registration be cancelled and bailiff fees removed because something has gone wrong at an earlier stage in the PCN process. In this particular case, you had not received any previous notices. Before being able to consider an Out of Time application, you would need to ascertain the REASON WHY correspondence was not received.

    PS: The council have advised you to complete form PE3. As the debt has reached bailiff stage, you would need to complete two forms....a PE2 and PE3.

    I've had exactly the same letter for exactly the same amount! No idea what it's on relation to, this is the very first letter I've received.

    Herbie I read your response on the other thread and realised I very stupidly hadn't updated my V5 (so stupid I know, I'm a relatively new driver and was in post natal depression fog when we moved, although I did update my driving licence address). Does this effectively mean I have no leg to stand on? Will I have to pay equita the £408?

    No, it doesn't mean you have no leg to stand on!

    Why does anyone here ever ask that, when the advice given is clear, that they DO have a way forward? We so often see clear advice then a person saying ''but...'' then assuming their case is different and that they are stuffed. Even though the advice told them that these cases do have a process and forms to be filled in, for exactly their scenario!

    Herbie's reply was clear. There is a process to follow.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
