DCB legal/VCS Building defense stage

Hi There,

Firstly, you are doing a great job and we all really appreciate you!

2 years ago I moved to the netherlands but kept good contact with the tenants of the house I used to live in. they sent me last week a couple of letters! the first from June 2019 from DCB Legal and the second a claim form northhampton county court dated August 2019 all relating to a PCN from a location in Leeds city centre August 2016.

I arrived to find that not one but both of the machines were out of order (I have photographic proof with date and gps location tagging) I looked for an attendant and nothing. I left the car there with a notice inside regarding the machine.

I am now at defence stage, I have completed AOS and need some help putting together my defense. Firstly, do I have to be there in court? With the evidence I have is it worth reaching out to DCB or Vehicle control services? I ticked the box the challenge jurisdiction, surely they won't bring it to the Netherlands?

    If you ticked the box to challenge jurisdiction then you have 14 days to pay £100 and fill in and send the N244 form, because you are challenging it, not defending it
  • Hmmm, I read on the newbies page the walkthrough on submitting AoS - it says 'do not contest jurisdiction this is if you live outside the UK and want your local authority to be used.

    I live in NL so I followed the instructions.

    Any answers to my other questions?

    If you are not contesting jurisdiction then proceed as normal, ticking that box gave you 14 days to fill in a form and pay £100, otherwise it reverts to a local claim

    As this is a civil case then attendance is not mandatory

    Proceed as if you are attending until 3 weeks before the hearing

    Then write to the claimant and court and state that you won't be attending and want the case heard on papers, it's not ideal but if that's what you want then do so

    No it won't be brought to the Netherlands, it's England and Wales only, so at the DQ stage you will nominate a local civil court in the UK, so maybe one near to where the court claim pack went ?

    Waste of time trying to settle out of court, but you could do a without prejudice letter of settlement to VCS

    Meanwhile start drafting your defence

    I do not understand, the OP does not live in the UK.
    You never know how far you can go until you go too far.

    The forms went to their old address but they are not contesting jurisdiction so are keeping their old address as an address for the service of papers
  • So seems i didn't really get the contesting jurisdiction but however is it a fair bet that if I don't send €100 and do not fill out the form the jurisdiction will stay where it is at northhampton?

    I can't seem to find any templates of a case like mine, can you point me in the right direction or something similar? as I said before I have evidence that the machines were not working and this is a common problem limiting the ways you can make payment for parking.

    I read the loadsofchildren123 guide to what to do and when, seems fairly straight forward but need a little help getting my defence started.
