I personally would not go the cash route because this driver might find in a day or two that they have whiplash.
Insurance is the safest way to go.
And make sure the garden is more escape proof as it could be a lot worse.0 -
I believe that the driver would need to prove that you were negligent, I'm sure I've seen case law about an accident with a dog that escaped for the first time against a dog who has escaped before and whose owners should have taken action to prevent it happening again. Incidents where nobody was negligent are covered by the drivers own insurance.0

If there is a successful claim made by the third party against their own policy then they pay their excess (which they can try and pursue the OP for - would need to prove their negligence to succeed)
If the third party makes a successful claim against the OP's insurer then with most policies there is no excess to pay.0 -
When a friend's dog was involved in an accident- it was killed- the driver's insurance company contacted my friend for payment of the damage caused to the car.0

I am uncertain about the negligence issue. I would have assumed RAC would be a reliable source. Maybe it’s not so black and white ???
