NCP and incorrect registration number

Hello all,
Can I please ask some advice. We parked an NCP car park a while back and recently I received a "Parking Charge Notice to Keeper" through the post (37 days after the incident date) , with my number plate taken from an ANPR camera in the car park.

We did buy a ticket, which fortunately I still have, however annoyingly I accidentally entered the registration of our other car and not the car I used. Is there any advice in this instance please? (Sorry if this question is already asked elsewhere, I did scout around but couldn't see similar queries. )

The 14 day half-pay period is due soon so wanted some advice how to proceed. Should I appeal online with a photo of the ticket we bought, even though its the incorrect reg?

Thanks for any help,
J

if you did they will state that the rules were not followed, meaning the correct VRM was not put into the PDT terminal onsite

use the blue text appeal te,plate , appeal as keeper and add a copy of the ticket as proof that the driver paid the correct fee, stating this in an extra paragraph

DO NOT REVEAL WHO WAS DRIVING

they failed the law called POFA , so the keeper has no liability and doesnt have to name the driver

so POFA is the best argument, because they failed the POFA timescale, but that only protects the keeper, the person they have written to

hence why the driver is not revealed, so no "MY , ME , MYSELF & I" blabbing about who did what or why , just use the blue text template from the NEWBIES thread near the top of this forum , in post #1, selecting KEEPER on their menu , attaching a copy of the ticket as proof of purchase , which means that legally this is de minimis

I'm sure Redx meant 'attaching a copy of the ticket'. :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Nine times out of ten these tickets are scams so consider complaining to your MP.

Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

  • Hi Redx and all,

Thank you very much for taking the time to help, it is much appreciated. I've taken a look at the template and will use/adjust this for my online appeal.

    Can I please just confirm:
    1. If I appeal but eventually its declined, will I still have opportunity to pay the lesser amount given in the 14-day-discount period?
    2. Is it okay to state that although the incorrect reg was entered accidentally by the driver, the driver still paid the correct fee for the duration of their stay and so its considered there is no loss of revinue for NCP?

    Thanks!

only if its in the bribe period, not that I would do so due to no keeper liability

that could be said as long as the driver is not revealed

    or you could say

by an occupant of the vehicle , the occupant still paid ...........

to keep it even more obscure, less blame , less blabbing

  • Great, thanks again Redx!

    Hi Redx,

I have now drafted my appeal, based on the NEWBIES thread but with the following addition (based on your help). I would be grateful if you could cast your eye over my additional wording below for anything which might be best left out (note that I wasn't sure about the predatory part of the template if it was relevant to my mistyped VRN?):

"A parking ticket was purchased by an occupant of the vehicle on the given date. It seems the occupant mistyped the registration but a ticket was purchased. To help resolve the dispute a copy of the paid parking ticket is attached

Under the Protection of Freedoms Act 2012 (POFA, schedule 4), NCP have failed the rules for Parking Charge Notice to the vehicle keeper. This states that the parking charge must be received by the Keeper within 14 days of the date of incident. The parking charge letter however was received 41 days after the parking ticket date."

    Thank you.

  • Hi All,

Just to let you know I had my parking charge cancelled.
