No response to initial appeal.

Quick question - Mrs. G received a postal PCN from a BPA company. Standard appeal from here sent, acknowlegement received saying they would reply to appeal within 35 days...

It's now some time beyond that and no response recieved (checked spam folder, sent ourselves test emails, etc).

Should we follow up and tell them they are in breach of their own procedures, or not prod them and see what happens?

    Check their website to see if there is an outstanding balance

    Double Check any email spam folders in case the reply was missed

    Balance on website showing - now without "early payment" discount.

    Complain to the BPA, also to your MP as nine times out of ten these tickets are scams.

    Parliment is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.
  • If the general feeling is to contact the parking company and tell them that they have not responded to the appeal within their own timescales, then a complaint to the BPA will be made as well.

    However, just trying to gauge if any contact should be made with the parking company at this stage (It's SR Parking, if that makes any difference).

    Do the complaint to the BPA now if SR are out of time.

    But what will the BPA do, I wonder. If they are going to contact SR and tell 'em to drop it, then great. But if they just make sympathetic noises I think I'd want to email SR to at least let them know that their failing has been noted and the BPA informed.

    There may well be a problem with contacting the PPC so see what more experienced folk here think.

    I would complain to the BPA straight off. They will "investigate" and claim it was sent but at least you've set your stall out.

    I agree with Waamo, these parking companies sometimes need a fire lit under them to make them follow the BPA guidelines , especially smaller companies who may sign up to the AOS but havent studied their responsibilities

    a wriitem emailed BPA Complaint can do 2 things

    1) make the PPC improve their processes

    2) drop it out of embarrasment

    Definitely complain to the BPA as soon as possible.

    As MistyZ says, you will probably be told it was sent.
    If you get a PoPLA code, use it.
    If the scammers say you are out of time to make a PoPLA appeal then you start making complaints about a breach of the ADR Act 2015, and demand proof they sent anything.

    Isn't it strange that more post/emails to and from parking scammers goes missing than from any other industry?

    Add a line or two to your complaint to the BPA authorising the BPA to discuss your issues with SR. Otherwise there will be a delay while the BPA ask you for that permission.
