No planning permission but building control approved for extension

    It will be treated like any other planning decision and allowed if it does not contravene the constraints applicable to the site. Councils do not try to put obstacles in the way of development; they just apply planning law. People usually get into bother with councils when they submit plans which do not meet the rules explained on the government's planning portal, or in difficult cases, take advice from a professional.

    You would submit drawings of your proposal without mentioning earlier work or placing any special attention on it. When I extended, I made no mention of an earlier extension, although it was obviously included in the drawings. It was never referred to by the council either, but obviously its size might have been factored-in to their considerations.

    You were talking about a 30% extension.

    Have you looked at the Permitted Development rules? Are you in the countryside? Greenbelt/National Park?

    That’s quite reassuring. If an extension is still possible then that’s good to go ahead.

    If I could do the extension in future and if the current extension is within the law considering the time limit (10+ years) I am considering to go ahead with the purchase. But the offer I put was purely under the assumption that the house is having all the required legal documents. The vendor didn’t even mention regarding the lack of planning permission even though I asked about the year and other details of the extension. This only got picked up during the Conveyancing process. Is it logical to ask for a further price reduction at this point?

    No, because none of this affects the value of the property.

    Why not just apply for a Certificate of Lawful Development if it troubles you (in laymans terms an admission they "got away with it" and we won't be taking any action)

    You were right to ask a direct question, because I was far too subtle asking about the constraints of the site and pointing them gently towards the Planning Portal. Presumably that just went 'whoosh!' because the OP is still worried about something that happened ages ago, in the mists of time.


    But they still didn't answer you.
