Please help with Gladstones LETTER BEFORE CLAIM

• Hello, i have received a LBC from Gladstones Solicitors from client: Minster Baywatch. They are looking to commence legal action to recover a debt that has been charges because i have allegedly parked in there car park MULTIPLE times. I currently have 17 outstanding charges which cannot be appealed. I was not parked in there car park, I work on site and i have my own building with my own designated car park, one at the front of the building and one at the rear.
  
• There are cameras and signs everywhere for the car park surrounding my building, and it seems that the camera system has been snapping my vehicle entering and exiting the car park. this is why i am accumulating charges

However i am only travelling through to get to the rear car park, if i enter my front car park i do not receive a charge, however if that car park is full and i have to go around the back, there is no other option but to go through their car park to get to mine. Its a separate, key code, gated car park.

I did not appeal these charges at all because i was advised to ignore them by the staff who work and accumulate charges already, i have only been working here for a year so i was inclined to take their advise. i have now accumulated 17 charges and have 4 LBC from Gladstone's solicitors and they are legitimate letters however they are not signed at the bottom.

SO: I Believe i do not have to pay these charges and YES i think i should have appealed these in the first instant but i haven't, i don't know whether this would've helped much at all reading many threads based on Gladstone's they seem to be vigilant in not caring too much and will push for a court case regardless.

Here is where i need assistance: I have tried to appeal, but they say its too late. i looked into POPLA, but that is only for when appeals have been denied but I'm still within the appeal dates. The charges are now with debt collectors OR with Gladstones, and Minster Baywatch say that they cannot discuss this with me.

I contacted Gladstones after sending a short email to them which follows:

"Hi I’ve been trying to contact you and the client about the letter I have received from yourself about chasing parking fines, please find the forwarded email I have sent to Minster Baywatch regarding this.

It says there email does not exist and I have no other means of contact?

I have also tried to appeal this on your website but it says my reference, 101411.5193 does not exist.

Please advise me on 07810648849 or reply to this email.

Thanks"

After sending this email and having no response, i called Gladstone's and they confirmed that had received the email and have put everything on hold. They advised that nothing further will happen until they have had conversations with the client Minster Baywatch.

After scrawling endlessly through information on this website (which is a much appreciated source of knowledge) I feel like i have neither gained confidence or lost any. I have just written out a letter which i intend to send to Gladstone's pushing this further but I'm in two minds of sending it.

This is the letter i have written:

Dear Sirs,

I have received your Letter Before Claim dated ../..../2019

I am requesting

- ALL photos taken of this VRN being parked and present in your car park

- All letters/emails sent and received, including any appeal correspondence

- All data held, all evidence you will rely on, and a full copy of the PCN, NTK

- a list of all PCNs you consider are outstanding against me and this VRN, all PCNs in one claim, not multiple separate claims.

I am currently seeking debt advise and need to gather all the details.

I do not wish for this to proceed to a small claims court case as I believe you have no grounds to support your case, hopefully we can together to resolve this issue outside of court, I feel I can provide enough evidence to show I have not been present in your car park.

You cannot presume that I possess all the documents referred to in your previous email, stating all my outstanding charges which was sent today's date being: 09.08.2019

I have heard nothing from Gladstone’s solicitors regarding my appeal email that I sent – after calling them they ensured me that all progress has been paused and that they are undergoing conversations with the client (Minster Baywatch) about my appeal.

Since contacting Minster Baywatch I have been advised you cannot discuss as this is now passed the appeal stage so I look to Gladstone’s for answers.

Multiple tickets have been incorrectly issued to countless staff at Folly Hall Mills 3, St Thomas’ RD, Huddersfield to colleagues, for this reason I am currently trying to make contact with the land owner as your client’s cameras are facing our gated private car park this is a matter of importance. Our private car park is not owned by yourselves, and is not since posted or camera controlled. It is a free parking area for the staff and customers of folly hall mills so can you explain in detail how we are accumulating charges and being threatened with court cases and debt collectors.

I would like to make a complaint regarding this whole process, as I feel that it is unfair that I have received a letter from Gladstone’s solicitors before having any contact from yourselves.

When all these details are supplied, please also confirm whether the intended action is founded on a contractual charge, a breach of a contract or trespass.

Please confirm that your client’s contract with the land-holder includes specific authority to take legal action for where I have been parking and this will be produced for the court.

When I receive the documents and your explanations I will be in a position to make a more detailed response

It would be unreasonable to proceed with litigation before you have clarified your client’s cause of action.

I have read the newbies guide regarding this issue, but i am still lost. I have no idea about legal proceedings and i have called citizens advice and they have simply told me not to pay. I really don't know whether i should be vigilantly fighting back or ignoring them further. - and when and if i do receive a court summons, i have no idea how to prepare for a defense or what i might need that will help me.
