  • Hi Everybody,

    I received a NOTICE OF INTENTION TO PROCEED the other day stating things like that if the claim is successful, a CCJ may be entered against me and that I may also be liable for their client's costs over and above what is already claimed.

    I'm assuming this is standard practice to try and put the frighteners on and avoid going to court, and should be filed in the appropriate manner?

    Yes, as you say, file that letter.

    Hi everyone,

    Hope you all had a good Christmas and New Year :)

    I received my DQ the other day and I've been reading the thread referenced in NEWBIES #2 about this. In that thread, the defendant reccommends asking for any evidence you will want to rely on early, so with this in mind, I was wondering if it was worth asking for a copy of the contract that relates to the COTTAGE space that the car was parked in?

    One other thing... I send the DQ back to the court, but also to BW Legal, KBT Cornwall or, both?

    Return your completed DQ to the CCBC in the same manner and to the same email address that you sent your Defence. Refresh your memory on that by re-reading post #24 above.

    Send a copy of your completed DQ to the Claimant - to the address in the box labelled Address for sending documents and payments on your County Court Claim Form.

    Which one? Their evidence regarding the contract? Ask away ... if they're relying on it then they'll need to send you a copy anyway with their Witness Statement.

    Well I now have my date in court allocated in early June, but wanted to get ahead of the game and begin my WS/evidence pack now. Regarding what @Coupon-mad said previously, would someone be kind enough to point me in the direction of the thread referred to, as I am having trouble locating it:
    That has been updated since 11th November, read CEC16's thread. But the new version wording can be saved till WS stage, so leave your Defence concise.

  • Evening everyone, hope you are all staying safe :) Given all that is going on, I was just wondering if people had any thoughts as to what the likely impact will be on court dates etc? I currently have to submit my evidence pack early May, with a court date early June. I'm assuming the latter will change, but what about the May date - will that also change, or do I need to stick to that?
