Help! Hsbc employer reference for dismissed employee

Hi, I was dismissed from HSBC for gross misconduct, I am appealing this but in the meantime I need a job. Does anyone know if HSBC include dismissal for gross misconduct in their references to prospective employers.

Most references will ask the reason for leaving.

I would assume HSBC would mention dismissal for gross misconduct if asked that question.

I believe there are special rules regarding references in the financial sector, although that may only apply to certain regulated positions.

If you come in that category then yes they will mention it plus they are legally obliged to provide a reference if requested, so they can't duck the issue by not responding.

However if yours was a "normal" not regulated job then it is harder to say. Some employers only confirm start and finish dates so if that is the case you may be lucky.

Most companies seem to be doing this these days. Saves on time internally because all that is needed is for a generic pro forma response to be generated, and also saves dealing with disgruntled former employees that do not like their reference. No idea what HSBC do though.

Rather depends what you did that HSBC believe constitutes gross misconduct. If a potential employer asks a direct question, whether they answer it or decline to respond to the question would send the same message to a potential employer.

That's not necessarily true at all. Companies that only send out pro forma references as a matter of policy usually make it clear in the correspondence that that is the only reference that they provide. You can't therefore read anything into a failure to answer a direct question, because them providing a pro forma reference happens automatically and is not based on what is asked of them.

... because you know HR people don't ever speak on the phone
  • Yes I am in a regulated role, I’ve heard that it is a pro forma standard response. The appeal and unfair dismissal case is going to take months but I just need any employment to pay the bills. Thank you
  • I can’t get any HR people on the phone to ask them hence asking on this forum.

What actually happened, because banks don't tend to dismiss people in regulated roles without good reason.
