Horizon Parking PCN

Hi,

I have received a Parking Charge notice from Horizon parking for a car I have on Personal Contract Hire. The RK of the vehicle have provided them with my details as Hirer.

I will be appealing today which is the 28th day after the PCN issue date. They have not supplied me with any documentation from the RK as per POFA paragraph 13

(a)a statement signed by or on behalf of the vehicle-hire firm to the effect that at the material time the vehicle was hired to a named person under a hire agreement;
(b)a copy of the hire agreement; and
(c)a copy of a statement of liability signed by the hirer under that hire agreement.

The PCN states that 'we have the right to recover the parking charge......... from the driver' as opposed to POFA paragraph 14 which states

(c)warn the hirer that if, after the period of 21 days beginning with the day after that on which the notice to hirer is given, the amount of unpaid parking charges referred to in the notice to keeper under paragraph 8(2)(f) or 9(2)(f) (as the case may be) has not been paid in full, the creditor will (if any applicable requirements are met) have the right to recover from the hirer so much of that amount as remains unpaid;

Will that be sufficient for my appeal using one of the templates from here?

    Surely not! This is a hire car case so the appeal template you need is one of Edna Basher's from the Hire Car section of the Newbie's thread. There are 3 links to appeals there and generally the second is the one people use.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    OP says it's PCH not "hire car"??


    But if OP is not the keeper(most unusual!) then yes- read up the section of hire cars in the FAQ (Though in that case appeal should have been done by now!)


    PCH is not conventional "hire car"!

    Thanks for that. Spent a fair amount of time trawling through the newbie thread before posting this and used the template you mention. Appeal now sent and looks as though that will be the end of it.

    It is a personal contract hire so still counts as a hire car therefore I am not the registered keeper.
