I just wanted to see if anyone could give me some advice around the parking grace period. I’ve read through a couple of threads, but I am still not sure where I would stand.
I have received a parking fine for Britannia parking I checked on my emails and I had confirmation that I had paid that day using the pay to park app.
I appealed the fine and sent the confirmation of payment however they have come back declining my appeal due to the following "a ticket was purchased for 24 hours, 42 minutes after you arrived. Your total duration of stay within the car park was 9hrs 54mins, meaning you have not paid for the first 32 minutes of your time in a car park." their argument is because I purchased the ticket 32 minutes after arrival and the grace period is only 10 minutes.
If I’m honest I’d never heard of a grace period before, I thought I would be ok as a paid-for well over the amount of time I was parked in the car park.
I am not sure where I would stand if I appeal through POPLA as it states if my appeal with POPLA does not go in my favour I have to pay £100.00 instead of £60.00.
I just wanted to see if anyone had any advice on whether it is worth appealing through POPLA or if I should just pay the £60?

impossible to say if popla would uphold your appeal or not, too many unknown factors like landowner authority , signage etc
grace periods are covered by the BPA CoP, clause #13 , hence their rejection, so yes the usual period is 10 minutes maximum under normal circumstances , so POPLA is likely to uphold their complaint about this aspect, because GRACE PERIODS have been around for a decade or more
to win at POPLA you need to win one one (any) technicality , but to argue a 32 minute grace period is a stretch by anyones imagination0 -
Popla may side with the scammers but a judge is more likely to apply common sense. I would invite them to give him/her a chance.
Nine times out of ten these tickets are scams so consider complaining to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.You never know how far you can go until you go too far.0 -

These are the main areas of appeal you need to research and understand and decide which fit your situation.
1. No keeper liability, including Notice to Keeper errors (PoFA 2012)
2. The operator has not shown that the individual who it is pursuing is in fact the driver who was liable for the charge
3. No Contract to manage parking
4. Signage
5. Consumer Rights Act 2015
6. BPA Code of Practice breaches
7. Why Beavis doesn't apply in your parking event
