Issue with NHSP

I’m a full time agency nurse and have been for years. Last week my agency informed me that all my booked shifts have been cancelled by NHSP but they’ve not been given any reason, and up to this date are still waiting for their reply. My agency are not able to rebook any shifts and it seems I’ve been banned/suspended from working at any hospital in my city.

I tried calling them myself this morning to find out what is the problem, but they won’t speak to me and said my agency has to contact them. The Sisters at the ward I normally work have tried to help but NHSP are not forthcoming with their reason for suspension. I have no knowledge of any complaints or possible complaints against me, and my Revalidation was passed and registration renewed. I have no clue what could have caused this!

I believe this is against any working standards, and I would like to log a complaint against them for loss of income, but have no idea where to begin. I suppose my agency could log this for me, but any advice regarding this is welcome. And is there anyone on here that had the same experience?

    Before launching into a form of action, I would suggest you thoroughly read any contract you have with the Agency and/or NHS
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    I’m sure I won’t find anything that says NHSP have a right to suspend me without conducting any investigation first or at least advise me of the reason for their action, but yes I will reread the contract. Thank you.

    They didn't suspend you.


    You weren't their employee.


    They simply no longer want to contract with you. That's one of the downsides of agency work.

    First things first - are you sure its not a problem with the agency? All agencies booking through NHSP must meet quite strict guidelines and if they breach these then they will be removed off the framework.


    Secondly, as an agency worker you aren't guaranteed shifts so its unlikely you could claim for loss of earnings.

    My agency are also none the wiser. NHSP are not responding to them apparently which is all so strange and rude. No communication whatsoever.

  • Double check all of your mandatory training is up to date. I had the same problem as a hca x

    I am no expert on the NHS. However, the general principle for an employer in using an agency is that although they pay more per hour, they avoid the obligations and commitments of employing someone. So, if the hospital no longer wants the services of a particular individual they can simply say to the agency "don't send XXXX again".

    I imagine you were also receiving a higher hourly rate than you would have done had you been employed directly by the hospital?

    If so then you have in effect traded your employment "rights" for more money in the short term but with no security.

    All you can do is carefully study the agreement you have with the agency and make sure they have honoured their side of the contract.

    It is unlikely that you have any direct claim against the hospital (although do check with somebody who is expert in this specific field).
