ESA and Receiving a PHI from work

HI all im having to fill out a esa50 form for ESA renewal been on ESA for 10 years. Also for the last 10years, ive been on a PHI from my employer. which ive has yearly reviews for. so my question is can the DWP find me fit for work even thou i receive this policy from work. which says i can't work. Also what happens if i get placed on the work related group. I can't look for work as im still employed.

Yes, they can still find you fit for work.

If you're placed into the WRAG, i'm assuming you're claiming Contributions based ESA because of the PHI? If so then Contributions based ESA is only paid for 1 year unless placed into the Support Group.

If either of these do happen then you have 1 month from the date of the decision to request the Mandatory Reconsideration.
  • Hi thanks for the reply.
How can they say your fit for work when you receive a PHI that's is to say you cant work. Also how can I be put in the WRAG when i already have employment. The WRAG is to help you get back to work. Is it not.

The Work Capability Assessment is the DWP's assessment - they are not bound by the opinion of others.
Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.

Permanent or Private Health Insurance. Receipt doesn't necessarily mean the recipient is incapable of any form of work. Payment is dependant on the terms of the policy, and may pay out because the recipient is unable to do the type of work. ESA assessments are to determine whether or not a person is able to do any form of work.

Are you receiving Contribution or Income-Based ESA?

Are ESA aware of the PHI receipts?

Did you contribute at least 50% towards the PHI premiums, or was the cost met by your employer?
