Next Step Advice

Hello all,
Please forgive for as I am knew to this, I HAVE read the newbies thread and need some further advice on my next step.

To provide a bit of back story I essentially was carrying out an inspection for a job on a flat block. I had been told by the client that they were located at the back of a car park in a private area, this area had a car park I assumed (Mistake) this would be for the flats so wrote a notice in my vehicle and left it there. I returned to my vehicle to grab a tool and was told by a man I could not ark here and he explained it was the back car park for the shop on the high street (pound stretchers).
I immediately moved my vehicle and later received a PCN notice from SMART PARKING.

I complained directly to smart parking and was unsuccessful I had passed the 10 minute grace period as i had been parked there for 10 minutes and 48 seconds!!

I stupidly did not appeal to POPLA within the period provided (Awful I Know) and subsequently received many letters from the DRP. Mistake number two here I called them and argued the toss and said I couldn't afford to pay the £170 they were demanding ( it was £60 fine originally) the lady on the phone advised me to 'just wait it out and see what happens then' i'm guessing this is in my favour that she said this?

I know this is why i'm being bombarded as they have sensed I am nervous about proceeding forward, the latest letter i have received is from GLADSTONE SOLICITORS (DRP using their name no doubt) I have also had letters from ZENITH (Again actually just DRP, correct?).

I will post the latest letter below, please can any advise me on what to do here, sorry if this is super annoying and I should have found the answer already but its driving me slightly insane!

Many Thanks in advance.

Next step is such an annoying childish term
  • I'm too new a member to post links to images, so essentially it says....

clients case says I am liable to pay this charge, supreme court case of bevis v parking eye confirmed lawfulness of charges.

the client now has the option to commence proceedings in an appropriate civil court. the right to do this exists for six years. a claim would result in an increase in the amount sought in terms of statuatory costs and court fees.

they then offer me the chance to pay the DRP 170 pounds or ask them to find a payment plan, they offered me three months when I called them before which I stated I still cannot afford.

If i do not pay in the next 14 days please keep the client and DRP informed as to my current address to ensure the liability to defend myself is protected. then speaks about CCJ's and how it affects credit ratings.

I am then provided with lots of places to call, national debt line etc, but not to call Gladstones themselves (presumably they don't even know about the case yet)

Everyone is asked to read up on this in the newbies FAQ thread near the top of the forum before starting a new thread

Go there now to learn about the game you are now caught up in

You are now in the wait and see stage

Ignore everything except a lbcca or court correspondence

If it comes to that then come back at that time for advice on how to defend this

They have 6 years to start legal proceedings against you

Throughout here you are advised never to reveal who was driving

You need to edit your post to remove details of who was driving

If you have used your real name as your forum name then you need to get MSE to change it to something anonymous

The ppcs monitor this forum and can use posts in your thread against you
