Driving Without Due Care and attention

Hope someone can answer this. How many points should someone expect if they crash into a parked car while distracted and 'caused injury' to the person in the parked car? Both cars unrepairable. The other person claimed for whiplash. The charge is driving without due care and attention and causing injury. Or could it be no points and a driving awareness course? No previous points or charges/convictions, 1 ticket for bus lane violation and 1 fine for speed camera violation; final year uni student.

  • It's my brotehr - he got 6 points and a £250 fine. Up in Scotand so don't know if we get the courses here.

    I would think there's no chance of just an awareness cause, as that is for minor speeding offences.
    A quick google suggests somewhere between 3 points and disqualification, plus a fine.

  • Anyone else had experience of this? What points/fine did you get? Did he get off lightly - he's ok about it but he was the main driver for the family so I was hoping for lower points and a higher fine.

    If he has already been convicted, what is the point in your original post?


    It's completely academic now.
    Eat vegetables and fear no creditors, rather than eat duck and hide.

    Indeed. Unless he's considering an appeal it's academic only. From your description of events six points seems a little light. I take it he passed his first driving test more than two years prior to the offence date?

    No courses in Scotland.

    Thanks for replies; he passed 3 years ago and he wouldn't reply to our texts so instead of twiddling thumbs, I wrote here. It was one of his fellow students who texted back (while on here) as brother went out drinking.......
    Don't know if he wants to appeal as came home at 4am so not the best time to have that discussion. But looking at replies, think best to leave as is.

    !!!!!! why should he appeal? He has done wrong and needs to take the consequences.
    In my opinion he has got off lightly.

    The court may agree with your opinion, and increase his sentence.
