    This might seem dumb, but at what point do you request a papers only hearing? And how?

    You can continue processing everything as if you intend to attend the hearing until about two weeks prior when you can inform the court that you wish for your case to be heard 'on the papers'.

    But against PE, I wouldn't hold out a great hope of success without being in attendance to argue your corner. They are pretty good at court stuff once they know they have decent case.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Not you can't... unless that representative is legally qualified.

    The cost of doing that would be disproportionate, and even if you win you cannot claim those costs.

    Do they turn up much? Or try to settle beforehand?

    PE's advocate from LPC Law always turns up.

    PE rarely make the first move to settle beforehand if they feel they have a good case to proceed.

    read this saga where I tried to impress upon the OP the lengths PE go to and my assessment of their chances in court , they wouldnt listen, until reality sunk in after the court case

    your court case would need to win on a legal technicality , so ensure you find one and expose it , if there isnt one you were doomed from the day the NTK dropped onto your doormat

    PE beat BARRY BEAVIS 3 times , 3 courts , 11 judges , they wont care about this case but will prepare well and know what they are doing , plus the BEAVIS case had defence lawyers and a barrister etc too, he wasnt on his own


    a cardiac heart surgeon,s first operation may have been an appendix as registrar or whatever in a teaching hospital, not a heart transplant on a royal family member at the best hospital in England


    your first court claim defence should be against somebody like Highview or CEL or APCOA , not PE

    Sadly I can't pick my battles in this case :(

    But I think I have made a quite important argument and that legally they have not followed the signage rules, and obviously the issue that 10 people own the land and they aren't clear or honest about which land they are allowed to operate on
