Unknown CCJ

Hello everyone,

I have just found out that I have had a CCJ awarded against me sometime last month by a PPC whilst checking my credit score. I have no idea what is it for. I have lived at my current address for over 5 years now and have never had a letter from anyone about this.

I have been reading through numerous threads, including the newbie one over the past couple of days to see what is my best course of action. From what I have read, the best thing to do seems to be to get a SAR from the PPC to get all the relevant information and then decide whether or not to apply for the CCJ to be set aside?

Any help/advice would be greatly appreciated!

    Is the address on your V5c correct? Don't guess go and physically check.

    Yes it is correct. I can't remember exactly when I sent off for the address to be changed though, is there a way of find that out? I know it won't have been straight away

    Look at the DocRef on page 2. That will tell you.

    Thanks. Looks like I only changed it just under 2 years ago. Is that a problem given that I've been here for over 5 years?

    The court paperwork probably went to an old address. You now have evidence of this for your set aside application.

    Do you know which ppc this is and the details yet? If not you could ask the DVLA who has accessed your data and go from there.

    Not yet but I will find out. Once I know who it is, am I best to ask them for a SAR? Then once I have all the information I can start my set aside application and defence?

    Speed is of the essence here. It might be worth forking out the small fee and doing a search on here https://www.trustonline.org.uk/

    That will show all ccjs against you and who got them. Next at the top of this board is a thread that tells Newbies to read it first. The second post in that thread covers the entire court process. It is now your bible.

    The quicker you act the better chance you have of getting the judgment set aside and the case starts over, at court level.
    Mortgage started 2020, aiming to clear 31/12/2029.

    The courts expect you to act without undue delay. If a judge thinks you've faffed around in getting a set aside then they can deny it on those grounds.

    They expect the application to be in within 3-4 weeks of you discovering it. They've been known to ask when you knew too.

    The logic is that if you haven't bothered then it can't be affecting you that much. Plus they don't like giving a set aside just because a ccj is causing a few problems. The whole idea of a ccj is to cause a few problems.

    What they want to do is grant one because it genuinely is in the interest of justice.
