What's the question now? The answer is the same.
It isn't Permitted Development. You can't appeal that because it's a simple fact that it is outside the scope of PD.
You need to apply for planning permission.
If that fails, then you can appeal, but I'd recommend working with your architect first, and planning officers second to find something acceptable that meets the local criteria.Everything that is supposed to be in heaven is already here on earth.

So, following my meeting the duty planner said that the second story is touching the roof of the ground floor extension hence this goes against the PD. I have an option to appeal, break my second floor extension or some how have a 200mm gap between the second floor extension and the roof
basically none of them are viable options. I need to now consider if I want to submit through the planning route.

Why do you need to consider it? If you want to build it, apply for planning permission, like people do every single day.
You're making a mountain out of a molehill here.
It is not PD. What is the point in appealing that? It is either PD or it isn't. It isn't. It needs planning permission. That doesn't mean it's a problem.

I did ask the planning team. Likelihood is low as both neighbours are not at 6 meters. He said he will internally discuss my case and revert if I should go via the planning route.
Btw do I need permission if I were not to use brick and mortar and build this using cladding and wood structure like a modern garden house or conservatory. I had a builder in today for quotes and he said I will not require permission if I built using steel frame, one wall from wood and insulation and cladding and rest bio fold....0 -

If that was true, that sort of structure would be going up everywhere. I can't see how it could possibly be true. Perhaps he meant it would be a lot cheaper to take it down if your LA decided to take enforcement action ;-)
