Getting money back

Hi

This is quite difficult and and I don't know what to do.

Basically I had £6k in my mums bank account for safe keeping, and unfortunately she passed away unexpectedly a couple of days ago. My sister and I are the executors of her will, and my son and my sisters 2 sons are the beneficiaries.

I don't know if there is any way I can get my £6k back out the bank, or if I need to legally challenge it to get it, or if I've lost it. My sister knows about the money and there's no arguments or issues. We are a very close family, so no problems with trust. I just didn't know if there is any easy way to get that money back.

My sister was just going to take it out mums account as she has all her login details, but I told her not too, because I'm sure she would be in pretty big trouble.

I can prove that I transferred the money as it was a bank transfer. If that makes any difference.

Any advice would be greatly appreciated. My head is all over the place at the moment, and I could do without adding money worries to that list.

    Is that the £6k you owed her?

    No, I didn't owe her anything, I'd merely moved it there for safe keeping. I was asking her to keep it safe for me while I saved up to buy something. I'm terrible with saving, so she kind of acted like my unofficial savings account. Haha

    I think you're worrying needlessly. If your sister knows about it and is an executor with you, there's no issue in getting the money back provided that the estate is solvent. If it has more debts than assets, than you will be an unsecured creditor and may not receive full repayment (but doesn't sound as if that is the case from your post).

    Thanks Dox. Yeah she didn't have any debts except her mortgage which wasn't very big and the sale of the house will be plenty to cover any debts she does have.

    I was just worried as our 3 kids were the sole beneficiaries that there is no way I could get that money back. All this will stuff is new to me and my sister, and the last thing either of us want is to be worrying about money.

    As long as it is part of the declaration of assets, it does not matter if its in the bank or under the bed, Far better for you to have access to it in this difficult time, as money will be needed for various matters. It does not sound like you have any intention of hiding it so be calm and don't worry.
