Oh and they are breaking OFT Guidelines by taking advantage of your lack of legal knowledge.
Come back here if you get any further contact (like it is not enforecable but you have a moral duty etc.)If you've have not made a mistake, you've made nothing0 -
Once again thanks for all the really helpful advice.
Just a few questions:
1) How do I know If I have a CCJ? I have checked my credit report about 3 months ago and there was no mention of any CCJ's or debt associated with me in the last 5 years.
2) I have never written to either HSBC or the debt collection companies, does this mean my debt is barred?
3) Does having a statute-barred debt affect my credit scoring?
4) What is the first thing I should do? Should I send in a letter to them as per the templates you have posted or simply ignore them and not call them?
Thanks again, your advice is genuinely appreciated.0 -

Just a few questions:
1) How do I know If I have a CCJ? I have checked my credit report about 3 months ago and there was no mention of any CCJ's or debt associated with me in the last 5 years.
This is not my speciality. Do not know what would happen if you had a very old CCJ. Obviously, you do not have a recent one re this debt.
2) I have never written to either HSBC or the debt collection companies, does this mean my debt is barred?
Unless they have an old CCJ ( for which you should have had paperwork at the time) or they can prove that you have delibarately hidden from them. I presume that you have made other financial arrangments that are recorded on your credit check over the last few years? If so, then you were not exactly hiding. The statute barred letter givs them the opportunity to provide any proof of either of these exemptions.
3) Does having a statute-barred debt affect my credit scoring?
None at all. They can only record defaults of enforceable debts.
4) What is the first thing I should do? Should I send in a letter to them as per the templates you have posted or simply ignore them and not call them?
Send the letters asap. Until you do this, they are entitled to keep asking you to pay. Once you have told them you are not paying, they should not make any further contact. If they do, complain.
Thanks again, your advice is genuinely appreciated.
