I wish I had thought to come here before I appealed.
This is my case in brief. We live in a Housing association house with no parking so we park on the road.Round the corner is a car park belonging to our housing association(always spaces here) and in the past we have used it - a sign is up saying residents of said housing association only.
We were asked to remove our car overnight so that the road could be resurfaced. we have nowhere else near to park (most of the houses are private with off road parking) so we went round the corner during the evening to the carpark to find new notices saying we needed permits. No advance notice from HA to say this was happening. We decided to park there as there was nowhere else within a 10 minute walk away to park.
We moved the car the next day once the work was complete only to find a ticket on the windscreen.:mad:
We appealed stating the unusual facts. they wrote in reply that even though they understood we had to move our vehicle we were still in breech of the restrictions of parking on private land.
I think this is unfair.
If we complain we lose the right to a reduced fine.
Do we stand any chance if we go to the independent appeals service ?

    only a judge can make the real decision on this , but may well come down on the side of PCM as long as the signage and landowner contract etc are all intact and valid
  • If your HA have employed these scumbags then a serious complaint to them should be your first move.

    So walk for a bit longer. If they took this to court you night struggle imo but, as nine times out of ten these tickets are scams, it may be worth complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.
