I've now received a Notice of Pending County Court Judgement from BW ?? just going to ignore it ... are there any comments re my defence - will need to submit soon ..

    thanks all
  • Notice of Pending County Court Judgement from BW ?? just going to ignore it

Well quite. Because they have to go to a hearing and win first. Nothing is pending. More accurately it should read "confirmation we've initiated court proceedings." It is BS scare tactics in that form. Even if they did get judgment, if you pay promptly there shouldn't be any problem.

So prepare your defence, assuming you're happy you've got one and press on.

As seen in many other BW Legal threads, a nasty letter that the Judge might consider as part of your list of unreasonable conduct.

I think you need to copy the format of a defence talking about the PACE v Lengyel case as that would be more suited. Search the forum.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Lengyel. As per my spelling above, just search the forum and SHOW POSTS.

Can't find ANYTHING on the forum, are you joking, it's used all the time!

The transcript is in the Parking Prankster's case law pages.

  • Received another letter from BW (12sept) "notice of intention to proceed" chance still to pay before ect . ect

ignored it and now have received a "notice of proposed allocation to the small claims track" - I'm guessing that I have to wait for BW to serve their papers before the dated specified (8th October) ?

Any ideas as to what's next ?

Have you now given up following the guidance in post #2 of the NEWBIES thread?

As you know, there are a couple of posts linked from there which explain exactly what's next.

    Re-read post #8 above.

bargepole told us all "whats next" 3 or 4 years ago, hence why you should ALWAYS study that post #2 of the NEWBIES thread before asking questions, its not as if you are the only one getting a court claim, tens of thousands are issued annually, with the same basic procedures , so its lack of research on your part

and as KeithP said, its in his advice too
  • my bad keith - being lazy - apologies

so busy at work just jumped on to update the post..
