CE LTD PCN appears POFA compliant

I received a PCN in the post from CE Ltd within the correct time frame and including photos.

Due to a failure of a parking app, I appealed to the landowner as best I could - sports centre manager said they had been told by CE to direct all queries to them and they weren't to discuss.


I have spent 3 hours reading the threads on here. It seems the starting point is the blue response in the Newbie's thread.

Keeper liability is being cited - I have gone through and looked at para 9 of Schedule 4 of POFA 2012.


I have also spotted some threads on here stating that CE's PCN's weren't POFA compliant however there appears to be new wording on the back which I think now may make it compliant.


I am not sure how I can obtain any info to prove I logged into the parking app and show how this failed. Someone must have the electronic records.

    email a SAR to the PPC and maybe to the parking app people too

    a landowner complaint is the best way to deal with this , so the first 25 days should be spent doing that , keep on at that business until they are so sick of you they relent and get it cancelled

    submit the blue text appeal as keeper on day 26 following the pcn date (the NTK that came in the post)

    so

    1) landowner complaint, as high as possible

    2) keeper template appeal

    3) popla

    4) court

    better it is cancelled by the business at source , so have another go at them , or several

    Out of interest I want to be sure this PCN is POFA compliant. Is there specific wording that should be mentioned - this states it is the drivers responsability but the Creditor does not have their name and address and therefore invites "you" to pay the charge. It does not specifically refer to keeper's liability.

    POFA compliance or not is covered in the NEWBIES sticky thread

    POFA itself defines the timescales and the wordings , as you found out, so check the NTK against those details and compliant notices like the Parking Eye ones


    it should include the "if after" words which is about 28 or 29 days, for keeper liability


    no point us copying and pasting POFA
  • Who are the sports centre ?

    Are they a private company or local authority owned ?

    Either way go higher than the manager perhaps the CEO or your local councillor.

    If the sports centre will not help write bad stuff of their website, Facebook, and TripAdvisor pages. Also get your MP on side.

    Nine times out of ten these tickets are scams so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.
