Hello,
My partner has just recieved a letter stating they are threatening to take her to court and progress a CCJ. I have read the 'sticky note' but cannot understand what my next stage would be?
I'd appreciate if somebody could point me in the right direction,
*How can i attach a copy of the letter?*
Thanks in advance.
James

I hope you haven't used your real name as your username. Ask a board guide to change it if you have.
Follow the guide to court written by bargepole you will find in post 2 of the NEWBIES. Assuming you have received a LBC, then you need to respond Robustly. A CCJ can't happen unless you let it happen.
What is the name of the PPC please?
To post an image, upload it to a web hosting site such as postimages or tinypic etcetera, then paste the URL here but change https to hxxps. Someone here will change it back to a live link.
Make sure you redact all personal data first.
Send an SAR to the scammers as per the NEWBIES.
Ask the DVLA who requested the keeper's personal data and when. State that you believe this information to be free.
What happened when you complained to the landowner?
You should also complain to your MP about this unregulated scam.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
Thank you fruitcake! How do i find a board guide to change it? (I'm quite new to posting on here)
I have today sent them a letter requesting SAR.
I think i have posted the image correctly.

Your vehicle registration is clearly visible.
When reposting, change hxxps to https and we'll be able to see a larger image than your thumbnail.Jameswild89 wrote: »How do i find a board guide to change it? (I'm quite new to posting on here)
To help with that, you might like to read this short extract from The MSE Forum Guide - Frequently Asked Questions & Rules:Q. How can I change my username?
A. In most circumstances, this is not permitted.
The only reason we will change your username is if it puts your privacy at risk. This usually means you've inadvertently registered using your name, email address or something that gives away your identity within your username.
If you fall into this category, email forumteam@moneysavingexpert.com and request that it is changed, giving three alternative usernames in order of preference.0 -

The parking companies trawl this forum just waiting for people to trip themselves up and can try and use posts in your thread against you.0 -
Was it your vehicle when the alleged incident occurred?
Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
Thanks for your reply The Deep.
It was my partners vehicle at the time of the alleged incident yes.
I will contact our local MP and complain about the situation.

Having read that letter, I'm afraid it appears your partner has already been issued a judgment in default which must be paid within a month of the date of judgment in order to avoid a credit crushing and life encumbering CCJ for the next 6 years.
Did your partner receive previous letters, in particular a county court claim from Northampton CCBC? Did she change address before or just around the parking incident and didn't update the car's V5C (logbook)?
Your partner's only hope is to apply for a set aside of the judgment if there are circumstances where she was unaware of any court claim. Set asides cost £255, with little prospect of recovery if the PPC has done nothing incorrectly.
Come back and tell us what you know, preferably with your partner alongside you to answer any further questions. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

That letter telling you about the ccj is suspicious
Why would a Claimant in possession of a Court judgement offer a massive 40% discount off the amount ordered by the court!? (And no reference to the Court claim number)
Check your partner's files at trustonline website to see if a ccj has indeed been given against you before doing anything!0 -

Indeed, they have not mentioned the date the CCJ was allegedly awarded. Check with the CC to see if it genuine. If it is, I would consider paying it as it could cost your partner £255 and still not be set aside. You will need to read about the reasons a set aside is awarded. You never know how far you can go until you go too far.0
