Hi,

I am looking for some advice.

An invoice from Europcar has been received for £90, £60 parking charge and £30 administration fee.

Does this need to be paid? They have provided the parking charge document that UKCPS sent them and it only shows a picture of the registration of the car and no clear picture of the car being parked in the 'unauthorised' area. No ticket was displayed on the car stating a parking charge had been given.

Europcar have advised they will be proceeding to court if this is not paid.

Thanks,

Everyone is asked to read up on this in the newbies FAQ thread near the top of the forum before starting a new thread

Go there now to get an understanding of the game you are now caught up in and how to deal with this

There's a section in #1 there with specific advice for hire car keepers
Throughout here you are advised never to reveal who was driving

You need to edit your post to remove details of who was driving

Please tell us the exact wording of your agreement with the hire company wrt fines, penalties and parking invoices from private parking companies.

    Have they paid the incoice?

Europcar have advised they will be taking me to court if I do not pay this

They might very well regret this, it depends on the wording of the contract you signed with them. There are several other threads asbout car hire companies paying these invoices and thus denying drivers the chance to appeal them or counter claim against the PPC in court.

Nine times out of ten these tickets are scams so complain to your MP.

Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

  • I have changed the wording,

I was unaware of the previous threads, thank you for pointing this out.

    4.7 all and any fines arising out of any traffic violations and/or my failure to pay congestion charges or parking fees. I also agree to pay an administration fee of £30 for any correspondence Europcar understakes because of any instance of a traffic violation or my failure to pay such charges or fees;

They did not give the opportunity to dispute the payment or pay direct. As no ticket was displayed there was no notice of the charge.

If you have the PCN, then appeal it as hirer/lessee using the relevant edna basher template from the NEWBIES.
If/when you win you will be able to ask Europcar for your money back as you will have proven that it was issued incorrectly by the parking scammers.

Tell the hire company not to pay the charge, and tell your card issuer not to pay it.

If the hire company has already paid the charge, then complain to them and their trade association, the BVRLA, as this is a breach of the BVRLA guidelines. Also complain that they have denied you the right to appeal this charge from an unregulated bunch of scammers.
In addition, put the charge in dispute as fraudulent with your card issuer, and tell Europcar you have done this.

You should also complain to your MP about this unregulated scam.

But this is not a traffic violation. If is an invoice from a thoroughly disreputable company for the damage they claim to have suffered when you did whatever it was you did. A judge is most unlikely to agree that they have a case, even if their timeline and documentation were tickety boo, and throw the case out.
