Sold Car, Buyer thinks we have mislead her
Options
Hi Looking for some advice.
I sold a car just under a month ago. It was a private sale, the car was in very good condition, previously bought from a dealer.
The buyer has came back to us saying that she bumped the car, took it to a garage to get the paint work looked at and the garage has told her that every panel on the car has been replaced at some point. She now thinks the car has been in an accident, is not safe and wants her money back.
I have had the car for 2 years and never had an accident, it has only ever been in the garage for the MOT,s which it recently passed. I had finance on the car from the dealer so the car went through all the safety/necessary checks for the finance before I bought it from the dealer.
Can anyone advise how I stand legally on this?

As above, just say you had no idea of any accident and that is the end of the conversation.0

What evidence does she have it's unsafe? It's got an MOT for goodness sakes. Good luck proving that in court.0
-
More likely she has crashed it, had it repaired and hopes you will buy it back. IMO Just deny any knowledge of alleged crash damage and cease contact.0

Legally - you stand where you are.
Have you kept a copy of the advert, previous finance documents/bill of sale from when you bought it?
The buyer will not be able to pursue you for anything, but if they do produce all of the above when the time comes.0 -
The onus would be on the buyer to prove you had misled them and that they had, as a result, suffered a financial loss. That would be extremely hard for them to do.0

I have all documents from when I bought the car and the hire purchase agreements ect. I also had a black box in the car which I think could prove that the car had never been in for a repair at any garage as it records every journey?0

It's a scam (probably). Make an honest, factual reply and then tell her that no further communication will be entered into. If she wishes to proceed to make a court claim it will be defended vigorously and you will pursue costs when you win.0

You dont need to prove anything - they should of HPI'd it before the bought it.
If the car has had previous accident damage repaired and not recorded then....any what? Doesnt make it unsafe.
I wouldnt correspond further but keep every text, letter and record phone calls, let them know though.
Dont offer to pay for anything, just confirm it was a private sale with an honest advert if you must.0 -
Not a pups chance every panel has been replaced.
And likewise, even IF the car has been painted, its not your responsibility to stand over the car.
If she wanted a car with a warranty and a guarantee it had never been repaired she should have bought new.
Not even a main dealer will warrant that a car hasnt had bodywork and they certainly wont refund the customer if it has.0
