the keeper named on the NTK appeals with the blue text template, no changes , as KEEPER
expect a rejection and referral to the IAS according to your paperwork
BUT, I cannot find them under R or S on the IPC AOS list, so are they no longer members ? if not , how did they access keeper data from the DVLA ?0 -

but not on the AOS list , only the corporate list
they are probably corporate members of the BPA too but not on their AOS list either
not being on any AOS list means they cannot access the DVLA database and not being on an AOS list means there is no ADR either
the question is who contacted the DVLA and what reason did they give ?
ie:- was it the landlord or owner using their private powers ? ie:- for trespass ?
I would contact the IPC and the DVLA too and complain , it may be a data breach0 -
The NtK isn't PoFA compliant (there is no formal warning that meets PoFA requirements), so there should be no identification of the driver revealed to the PPC, especially in this thread - so please edit any such detail. You must at all times deal with this as 'the keeper'.
This is a rather tangled web of an umbrella organisation (Solution Labs) using one of its operating arms (Regent Parking) to provide a further umbrella service for start-up PPCs.

While both are members of the IPC, neither appear to be members of their Approved Operator Scheme (a pre-requisite for obtaining RK data from the DVLA), so I'd be asking some very pointed questions to the DVLA, like who accessed your data, the method by which they accessed it, and with which company does the DVLA have a KADOE contract.
Ask the DVLA to investigate which start-up company might be involved under the various umbrella organisations, and is the DVLA content that your data has been handled correctly, because you certainly don't think it has!
Give them the date of the parking incident. You need to provide the registered keeper's full name and address, the address on the V5C logbook and the Vehicle Registration Mark of the vehicle involved in the parking incident.

Thank you for your appeal against the above Parking Charge Notice ('PCN') which has been carefully considered, however, on this occasion,the appeal has been rejected for the reason(s) detailed below.
Your vehicle was observed as being parked in a Permit Holders Only parking space, without clearly displaying a valid parking permit. Notice of the terms and conditions of parking is served by way of numerous large warning signs which are displayed at prominent places throughout the site.
Whilst we note the contents of your appeal, we would advise that a permit is required to be on display at all times when parked at this location. Failing to display a permit results in a breach of the terms and conditions of the site.
We also note points you have raised within your appeal and we will address with the following responses.
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be
making a formal complaint about your predatory conduct to your client landowner and to my MP.
Our Client rejects this argument. By way of large warning signs displayed at the site, our Client advises motorists that
terms and conditions of parking apply. If a motorist does not wish to be bound by these terms and conditions they are free to leave the site and to park elsewhere. By choosing to remain parked on-site, by virtue of your conduct, you have affirmed your acceptance of the displayed terms and conditions. As a member of a Trade Body our Client is required to undergo strict site audits prior to being permitted to issue parking charge notices. We confirm that this site has passed such an audit.
Furthermore, we refer you to the photographic evidence which shows that there were large warning signs present within the immediate vicinity of your parked vehicle. It is our Client's case that due to the proximity of these warning signs to your
place of parking, it is reasonable to assume that that you had sight of the terms and conditions prior to choosing to park on
site.
In line with the International Parking Community ("IPC") Code of Practice, the Operator allowed the requisite grace period .
You were recently served a Notice to Registered Keeper ("NTK") in respect of the above parking charge notice. This letter was sent in accordance with the provisions set out in paragraph 9, Schedule 4 of the Protection of Freedoms Act 2012 ("POFA"). You may be aware that POFA 2012 makes provision for Creditors to recover unpaid parking charges, from a vehicle's registered keeper, if, inter alia, they are unaware of who the relevant driver of a vehicle was after a period of 28 days from the date
of issue of the NTK.
We have requested on more than one occasion, that you provide us with the relevant driver's details, and you have refused. On this basis, please accept this letter as confirmation that our Client intends to hold you liable for the unpaid charges.We
therefore invite you by return to contact us with your proposals to settle the debt. Alternatively, please furnish us with
the driver's name and address on or before 19th August 2019.In the absence of the driver's details or a payment, our Client reserves the right to instigate further action to recover the debt.
You have now reached the end of our internal appeals procedure and you now have two options (you cannot do both):
You can pay the total amount due of £60.00 within 14 days (see reverse of letter for payment options). or you can appeal to the Independent Appeals Service (IAS) if you believe this decision is incorrect
In order to appeal the IAS will need your PCN number, vehicle registration and the date the charge was originally issued. The IAS (https://www.theIAS.org) provides an Alternative Dispute Resolution scheme for disputes of this type. As you have complied with our internal appeals procedure, you may use and we will engage with, the IAS Standard Appeals Service providing you lodge an appeal to them within 21 days of this rejection.
IMPORTANT NOTE:
Should you decide to appeal to the IAS and your appeal is subsequently rejected, the option to pay a discounted amount will no longer be available and the full amount of the PCN will become due, payment should be made to the Operator within 14 days from the date of the IAS rejection notification.
If you do not make payment, the outstanding PCN will be passed to our appointed debt collection agency for further action and all costs associated with this process will be added to the amount outstanding.
