Amazon / Ebuyer - Sold me a second hand device as new!

I purchased an Apple Mac Book from Amazon UK through a third party seller (Ebuyer) in September 2018. The device was sold for over £1200.

The item was sold as "New".

I've had problem after problem with it, not charging, keyboard sticking - it's basically unusable now as the battery has died. I contacted Ebuyer who advised me to take it to my nearest Apple store as it had warranty as a new device.

The Apple store were really helpful and advised that the device was full of debris that would suggest it was much older than the date of sale. They traced it back to being sold by Dixons and activated on 5th May 2017, making it over a year old when it was sold to me - and no longer under warranty.

I've complained to Amazon and Ebuyer in writing - both of whom are ignoring my emails. I've phoned Amazon UK who told me to put something in writing - which I have, twice. They've had over 2 weeks to respond but still I've heard nothing?

Can anyone tell me what the next steps are? It's a lot of money and I feel like I've been completely duped :(

Any help would be much appreciated.

    Dixons ceased to exist in 2014.

    Does not make sense for Ebuyer to send you to Apple if they knew that it was not new .


    Dixons could be the DSG group .

    No, DSG Retail Limited has been trading continuously since 1952. The sign above the door has changed over the years though.

    Go to your Credit Card Provider, Section 75 claim, not failed me yet however if you used a Debit Card it could be more difficult.
    I find Amazon really good with resolving issues so keep contacting them via web chat until they do something.

    They might mean DSG in the airports, which still trades as Dixons Travel (see https://www.dixonstravel.com ...)
    Currys and dixons travel are both part of "Dixons carphone" group.

    We have a policy never to use Ebuyer as they behave unethically
    This is because that will take your money for next business day delivery give it to shoddy couriers who lose it and then Ebuyer will tell you you have to wait till they have investigated and then your goods turn up a few days later

    They also (allegedly) prevent you from using a manufacturer warranty, if you contact them first about faulty goods. Example:

    * You buy a graphics card which has a 3 year manufacturer warranty. (They use the warranty as a selling point).

    * The card fails after 1 year so you contact Ebuyer to RMA the card for a warranty replacement

    * Ebuyer give you a partial refund (legally, as per consumer legislation)

    * Ebuyer use the warranty with the manufacturer to get a new card which they then sell for retail value (but without a warranty)

    Allegedly. ;)

    Do you still have the listing? Does it refer to being new in the description?

    What type of MacBook was it supposed to be? £1.2k in 2018 is pretty cheap for a brand new one, is it an m3?
