    From my experience, I think it more likely the builders put it in the wrong place. Especially if it's the original buyers selling and they're claiming ignorance.

    Apparently not - I went round to the property yesterday to discuss with the owner. The fence is as they bought it (And they have photos to prove it). Suspect the builder has just "pinched" a bit of land in order to put a straight fence up

    If is is extra then that is less of a problem not enough.

    You can tell the solicitor you understand that if someone claims the land you will be happy to give it back.

    The fence deck can stay as iss a a bit of string put up a temporary boundary indicator.

    Exactly this but do be aware that the indemnity insurance covers you for costs of the reinstatement of the original boundary, I.e. pays for you to move the fence and decking, and possibly if it is good insurance it might pay for some legal costs. It doesnt mean that if someone claimed the land that you would be able to keep it..Adverse possession can be applied for after 12 years but it isnt a given that it would be approved.
