CCJ for Private Parking: Please help

Hi,
Please I really do need advise with this County Court Case:
I would be very grateful if anyone can help me with this. Before getting into details I just want to state from the start that:
- I am willing to pay the full amount claimed;
- Most importantly, I need my credit score unaffected (currently my experian is 970), as we have just applied for mortgage, we found the house we wont, and our offer has been accepted. This is a crucial moment for our family and we would really appreciate any help.
Case:
- Back in 2017 we(me, my wife and the kids) paid and displayed in private parking administered by KBT Cornwall but were late(as I remember it, it was about 10 minutes, but the evidence shows it was 19 minutes. We found the notice on windscreen. We did not pay the £100.
- We moved to a new address and updated DVLA records.
- All correspondence from KBT Cornwall, then Gladstone Solicitors, Than Northampton County Court was send to old address so we were not aware of any of this until March 2019.
- We become aware of a CCJ on my name when checking experian in 2019 March: my credit score was ruined and we could not apply for mortgage.
- I appealed asking the Court to set aside; payed £250 to court;
- The case was transferred to County Court at Kingston-upon-Thames;
- Me and my wife went to court in March, provided evidence of change of address (after the incident the vehicle was transferred to my wife and DVLA records / address were updated accordingly)
- The case was set aside in March 2019.
- My experian score was back to excellent.
- I have acknowledged Gladstone Solicitors of my current address;
- On 15 April 2019 we received a Notice of Trial Date for 24 July 2019, at Kingston-upon-Thames County Court
- In June and July I have contacted via email both KBT Cornwall and Gladstone Solicitors asking to settle this outside the court, offering to pay their claim. They did not respond with any amount claimed.
I have sent them 4 emails asking to settle this amiably and offering to pay their claims.
The only response I got was an email from Gladstone on 05 Julay 2019 (photos of the car with timestamp, photos of signage + KBT employee statement):
"Please find attached, by way of service, the Claimant's Witness Statement.
We confirm the statement has been filed at the Court"
- I did not fill any defence. I prepared a defence (emails showing my willingness to settle this, and their attitude which I consider to be harassing, abusive and intimidating) and I planned to attend the proceedings at Kingston-Upon-Thames, on 24th of July.
- Unfortunately, due to an ankle injury I could not attend the proceedings on 24 July 2019.
What to do now? Please, if anyone can help me in how to deal with this, please help!
At this point I am willing to pay, even an excessive amount, just to have this Gladstone nightmare out of our lives.
We have been accepted an offer for a house, we have our Mortgage in Principle and we made a full application for the mortgage yesterday 26th of July 2019.
I want to avoid, at all costs, our mortgage/credit score being affected by this.
I do understand that if another CCJ is made, and if I pay the full claim within 30 days, there will be no public record of this and this will not affect my credit checks in any way. Is it safe to wait for Court Judgement and pay?
The Court, Gladstones and KBT all have my current address - but if for whatever reason I don't receive the post my credit score will be trashed for 6 years. I just want to have the peace of mind that this case is closed and it won't affect my records.
Could a bank/lender find about this Case now? A new CCJ has not been emitted, and the old one was set aside - but the last proceeding was on 24th of July and I could not attend due to my ankle injury and I don't know the outcome of this.
Thank you so much for taking the time to read - all this experience was very demoralising for me - and my wife - I would greatly appreciate if anyone can advise me on this.
Kind Regards,
Andy

Assuming that the hearing went ahead without you then it's highly likely they won.
You can check your record now at trustonline
If you have a new ccj it will show, and your lender will be able to see it
If you do have one and want to pay it, then you must pay the claimant (not the Court)
Make sure you get a receipt!0 -
Hi Quentin,
Thank you for your reply.
I have checked both trustonline and experian: there is no CCJ against me at the moment.
However I want to pay their claim, and not wait for a CCJ.
The problem is the claimant completely ignored my emails where I clearly stated that I am willing to pay their claim.
What else can I do? Trying to contact KBT Cornwall (the Claimant) again seems my only option at the moment. If anyone else has other suggestions please reply.
Thank you again for help,
Andy0 -
If you pay the claim within 30 days it will not show on your credit record. Wait until you get the court paperwork. You absolutely must get proof of payment to show the court.0

A ccj does get registered against you immediately it's issued.
Though will be removed from the record if the Court is notified that payment in full has been made within a month of the date of judgement
Indeed. I could have been fuller in my answer. Trustonline is a register of ccjs and not a credit record. It takes a while for a ccj to filter through to the record.
As it's put on and removed quickly it doesn't actually filter through to the credit reference agencies.0 -
It doesn't work like that.
Anyone doing a paid for search of the register will be notified of any ccj registered there irrespective of the date of the judgement
Experian etc are notified daily, but choose their own timescales when they update their free credit files, which are a different issue to the paid for types of searches employers/lenders etc carry out0 -
Me and my wife went to court in March, … The case was set aside in March 2019.
- My experian score was back to excellent.
I am confused, why have they claimed again?
Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.You never know how far you can go until you go too far.0
